Hiya all,

 

Just trying to help a friend of mine out.

 

Last year she suffered a severe rape and sexual assault and has been off work ( until last month ) and receiving specialist police counselling for it.

 

In this period of time she has got behind in repayments and one debt ( to an individual ) has gone to the high court

and baliffs have attended when she was not in ( total was £3750 )

 

She has offered a proposal of £400 per month

but they have come back and said they will only accept £1000 per month

and £750 upfront which there is no way she can afford as her wages for the month are £1400 after tax

 

She still suffers from severe anxiety and I am really worried about her as this has already put her more in her shell

 

Am I right in assuming that as she has a crime reference number for it and is under counselling she would be classed as a vulnerable person?

 

I have told her not to answer the door to them

but its already having a huge effect,

she missed a recorded delivery yesterday as she got herself into such a panic when the door went

and had to miss a day off work because of it

 

I am going to help her write a letter to the baliffs but need to know where I can go to make sure it is written properly.

 

She has a PPI claim coming back - which I did for her - in 2 weeks but they rejected waiting until then for her to pay it all in full

 

Any help would be greatly appreciated

If you open the NSEA doc, page 9 it lists Vulnerable Persons, I'm not an expert, but I would suggest your friend is indeed a Vulnerable person.

The debtor, or their representative, must urgently notify the HCEO by fax, email or telephone of the very disturbing circumstances in which she finds herself. Clearly once armed with the facts the HCEO can consider the vulnerability circumstances.

 

Due to Data Protection the debtor will have to let the HCEO know that the representative can act on their behalf.

 

The sooner this contact is made the better. Without this a further visit is likely and this will clearly only make things worse.

I just wanted to say a big thanks to all who have contributed on this thread.

 

She spoke to someone passed onto her through PlodderTom and they have put the account on hold and stopped the enforcement action

Hello all again,

 

Many thanks for all the help previously

 

Just as an update my friend has agreed to pay the amount next week and asked for a breakdown in fees which has been provided

 

Included in this is a fee of £687 in interest to the claimants ( separate from the baliff charges )

 

My question is if this is allowed? She has an email just one month prior to the enforcement action from the claimants in which the judgement total was requested but no additional interest charges so they seem to have added that on once they have decided to go down the enforcement route

 

I don't want her to pay it only to later find it was not enforceable and should not have been on there
