cabot/HL legal old cap1debt- claim form received from capquest

Thanks for the reply, I think I have attached a scan of the credit agreement they sent me, Further details are as follows:

 

Original lender is capital one,

debt is credit card,

amount is £398.40 and Capquest have it now.

 

 

They sent me claim forms back in dec and I replied disputing the amount,

 

 

I have not heard anything back from the courts or Capquest with regards to the claim forms,

 

 

however they are quoting the claim ref on this latest letter.

Forget the CCA argument, they have issued COURT PAPERS, this takes precedent.

 

What has happened to the claim?

have no idea as far as the court have told me its in the hands of capquest to decide what to do :/

So, it's 'stayed'? You need to check this is the case with the Courts.

 

Did you ever send a CCA request to Cabot, the SAR to Capitial One and the CPR31.14 to the solicitors?

 

If not, I would be doing that yesterday.

i asked for help and was told to ask for a cca but that is it

Ring the Court tomorrow and check it's stayed. Post back here to confirm,

 

They may have got judgement by default.

 

We can then send the correct letters out.
