Warrant of Execution - After Final return of your claim was received

 

I rececied a noice from MCOL - 'A final return for your warrant against Mr XXX was received on 06/11/2013', I am not sure what it means and why I suppose to do next.

 

Few months ago, I started a claim that a guy own me £3000. He was my 'londlord', I paid one years rent but I only live there for 6 months, now he cut himself off from facebook, phone, email, ect. From my other resourse he might move out the house cause he was not a 'landlord', he rent it from someone else. I fear that court can not trace him and help me get the money back. What happen if court could not find this person from the address I provided?

If you cant find him, and the court cant, then youve lost your money. Thats why you need to do a lot of research before you take out the claim, so the other party has no chance of evading action.

I have his phone number and email address, his pics, is that can help? Or there are anything else I could do?

You need his address so a bailiff and court papers can be served on him. Phone numbers/emails/pics have no bearing.

Does he answer his phone? Respond to emails?

Do you know where he has a bank account? Does he have a car and if so, do you know the registration number?

Has he got the money you want if you find him? If you are not sure it probably would not be worth spending too much money in tracing him.

He doesnt answer my phones and emails. He also deleted his face book account. But my friend saw him in London once and I known him also working in London too. Got his Linkln but no address. I was pay him by cash cause he requested me to, he has a car but I did not record plate number down. I guess he have the money cause he got some properties for rent in London. Do you think I should pay somemoney to private detective to trace him?

Your best bet is to use a tracing agent of some kind.

 

Most High Court Enforcement companies have their own in house tracing teams and will usually do it for free if they get the job of enforcement.

 

With that kind of sum you're much better using an HCEO anyway. Not only is it cheaper to instruct (£60 v £100) but you'll stand a greater chance of recovering your money.

Final "return of the warrant" means that the County Court bailiff has been unable to collect the debts and that as far as he is concerned, his file is now closed. If the debt was for just or under £600 there would be very little that you can do, however, as it is over £600 you can simply pay a fee of £60 to have the judgment "transfered up" to a High Court Enforcement company.

 

The other alternative would be to apply for an "Oral Examination" in the County Court. These are pretty effective and are used often by solicitors chasing money from their own personal clients. The pitfalls.....you could be waiting as much as 4-6 months before the court list the matter for hearing. The main pitfall however is that you need to have the precise address of the debtor as such an application requires "personal service" ( by way of a process server).
