Hi,

 

I am looking for some advice on behalf of my mum.

 

She is currently paying Welcome £460 per month and her Mortgage company £600 per month.

That is the majority of her income for the month on two secured loan repayments!

 

Having spoken to her she is getting quite down about it, as you can imagine.

 

She is a 64 yr old widowed woman and could really do with reducing both of these outgoings,

but as I understand it she cannot involve these debts in a debt management plan or IVA.

 

I think she has been to court previously for both the mortgage and Welcome loans and there is some kind of order in place.

 

A couple of months ago she phoned me one evening in floods of tears asking me if it was right that Welcome Finance can force her to sell her house!

 

She had a call from someone there telling her to rearrange a new mortgage and pay them back or they will force her to sell!

Outrageous practice!

Unfortunately she did not get his name etc.

 

Is there anything she can do to reduce payments to Welcome or the mortgage company?

 

Any help is much appreciated!

as far as welcome go

 

never trust anything they say or do.

 

get all the info

 

if shes not got ALL the statements and the agreements

 

send welcome an sar asap.

 

she needs to stay off that phone!

 

tell her to say writing only and put the phone down to them.

 

they are 2nd inline with the house

 

the mortgage company will be none too happy to find welcome are threatening what they are.

 

mortgage comes FIRST!!

 

get that info via sar

 

can you scan the letters she already has and the CCJ etc please?

 

bet it wasn't welcome that got the ccj?

She is away until tomorrow when I will find out more details of who took her to court and what happened.

 

In the mean time could you inform me what an SAR is please.

Ok having had a conversation with mum here is the deal...

 

1. She has no current paperwork for the loan that she can put her hands on so we will send an SAR to get that

and post it here when it arrives.

 

2. Welcome have never taken her to court, that was her mortgage company, who were granted a suspended possession order.

 

3. For a considerable amount of time she was actually overpaying on her account, to the tune of £50/month.

 

4. Prior to making her last payment, she was being hassled by Welcome on the telephone. When she eventually spoke to them

they questioned why she had not prioritised paying them over her mortgage company!

 

What would be the implications of simply refusing to pay it? Would this force them into a situation whereby they would have to perform an income and expenditure assessment and freeze interest (if not already frozen)?

tell us what shows for these two decured welcome loans?

 

are there two with welcome?

 

just to be clear

 

her MORTGAGE COMES FIRST

 

drop whatever is needed from the welcome stuff to pay the mortgage what it wants - end of no argument.

Do you know when the welcome loan was taken out and how much it was for. Also are you sure they hold a second charge on the property, it has been known for welcome to say a loan is secured when in fact it is not.

 

Is it possible to get the agreement for this loan also.
