Dear All,

 

Advice required, next steps.

 

Lloyds have previously sent a compensation amount,

 

I subsequently sent a SAR request and CCA request this gave me more information proving their compensation amount was incorrect.

 

I now have statements back to 2000, however I think the account was opened in 1983.

 

I do not have this data,

 

Lloyds have failed to provide the data saying they only have to keep records for six years,

 

however the CC department say their records say it goes back to 1990, but I do not have this on paper.

 

I have created a financial model to reflect all statements back to 2000 then a straight line balance and PPI charge back to 1983.

 

I would like to claim the full amount know, as I see it I have a number of options;

1 Go directly to Lloyds with my claim

2 start a pre action disclosure to ask them to give the date the cc started

3 take my case to FOS as I seem to have exhausted evey avenue from lloyds

 

I am wondering if these are the only options and what anyone with experience of this would advise?

under FOS guidelines yu are entitled to use an

avg PPI payment for the months tou do not know

you are also entitled to use an AVG of the APR used

Thank you for your response, yes the card is still active. I now have a date the card started.

 

The card started in 1990 and throught a SAR request I have data back to 2000.

 

I am still not sure how to quantify the charge where I have no records.

 

You mention using an average PPI amount, do you have an example?

 

It has been mentioned I might take the start date as 1990 as zero balance then extrapolate to the balance in 2000 (from records) so there is a stepped increase.

 

However the balance in 2000 was quite a bit lower than the average balance on the account so this might not be prudent.

 

There are obviously different ways of calculating the 'void' period but my question is what is the best way to engage them to pay me?

 

Is it directly ot the back, through the courts or through FOS. Is there anyone here who can advise on court procedures and costs?

slow down.

 

for the PPI payments you have documentary evidence for

work out what the avg payment was.

 

on the months you do not know the PPI

use that avg.

 

then enter the details in to the spread

use the AVG for months unknown

use the actual data for the months you do know

 

then fill in this CISHEET

 

CISheet v101.xls

 

use their avg int rate in cell D 15

 

then comeback
