Hi everyone, fairly new to this site but desperately need help.

 

I have been in dispute with 1st credit for some time now and have managed to stall them until now.

 

Today Moonbeever sent me a court summons for the amount £12XXX.XX which I am very worried about.

 

The debt came about through a credit card and Lloyds.

 

Last time I sent any type of payment was Oct 2007 shown on a statement in Nov 2007, so I guess its not quite statute barred yet.

 

What do I do?

 

Any help much appreciated !!

Typical... when the SB status is approaching.... They issue court docs...

can you block out any info and post the letter up here via scanner or other method?

Ok I will scan the details on the form as soon as poss. Do you just need the front page of the court summons.

I may have a letter from ages ago stating the details of the claim as well .

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all monetary figures and dates.

put them in a word doc FIRST and convert that to PDF

convert existing PC files to PDF [office has an installable print to PDF option]

..

 

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice dd-mm-yyyy TSB

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

Thanks guys for looking at this.

 

I did request copies of contracts, statements etc which they sent a long time after the statutory time limit.

These were photocopies only though.

I am really sorry. This site has saved my bacon so far just by reading other peoples plights and downloading template letters etc.

This time however I need to get it right.

Hiya ims21.

 

The date on the claim form is 23 Sept 2013.

 

I believe I have 5 days then 14.

 

Is this working days or not.

If not what date will they have to have received some sort of response.

 

The dispute has arose because of unpaid debt.

Interest rates were killing me and just got totally out of control.

The last time any payment was made would have been in Oct 2007 as it shows on a statement from Nov 2007.

Ok so your time line is 23rd + 5 for service 28th + 14 to acknowledge =12th October. So your acknowledgement of service must be in by 12th October at the latest.

 

If you plan to defend then you will have a further 14 days to enter your defence which will be due by 26th October.

doesn't constitute a dispute.

 

What steps (if any) did you take with them to try and resolve the problem or did you simply just stop paying?

 

You will need to give chapter and verse on this in order for the guys to be able to help you.

Hold on people, this is a statutory demand, not a conventional claim form.

 

You have 18 days from the date this came into your hands to deal with.. Give me a few moments and I will have a proper read of the demand.

 

OK, panic over - reading through the paperwork.. slowly and with my glasses on - I see the Stat demand was withdrawn and a proper court summons was issued.. phew.. !!
