Several years ago my now estranged future mother-in-law (had no contact since she fell out with my partner)

paid off roughly £2000 in rent arrears for me as

I'd fallen behind due to one of the DWP's oh so lovely unexplained "errors" whereby

my benefits were stopped with no notice given to me by either letter or phone.

2 months and several phones later my benefits were finally reinstated

but I never received an explanation for why they'd stopped as I'd had no change of circumstances at the time,

and also no apology for their mistake also

plunging me into £2000 worth of debt to Halifax bank

- the result of me receiving no notification from the DWP and

my household bills continuing to go out which the bank refused to cancel,

ultimately resulting in a LOT of overdraft charges.

To this day neither the DWP or Halifax have apologized or acknowledged their part in what happened,

and I have been left paying the debt back to a recovery company who are thankfully very understanding and helpful.

Can anyone advise me on how to proceed?

also this Halifax OD, you are paying off a debt mostly made from PENALTY charges to a DCA...urm..i'd question

the wisdom of that.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

R.E Halifax - I questioned it all until I was blue in the face, was never given an explanation. I ended up switching to LLoyds TSB and had no problems since.

R.E loan - There was never any written agreement, it was an understanding between the two of us. Also she lives a wardened block of flats so if she were to refuse to let me in the security door i still wouldn't be able to pay her.

  • 3 weeks later...

The DCA i'm paying is Moorcraft, I got a letter from Halifax stating they were handing the debt over to them, presumably because they'd gotten tired of my debt management solicitor refusing to budge on the subject of my paying them back with money they thought I could conjure out of thin air at will.

the Halifax OD .. I would get an SAR off to them and get all the statements

look for all the PENALTY charges they have levied.

if this is since nov 2009, then i'd consider a bcobs complaint.

i'm worried you are paying a dca on this.

you need to be SURE all you pay them IS going off the balance.

is this on yourCRA file under Halifax?

in regards to halifax

i've had no dealings with them since i closed my old account so i have no idea what's on file or isn't,

as far as i know they handed everything over to Moorcroft.

I do know that my balance is going down with moorcraft as i use their online payment service and they recently called me to confirm my balance has now gone under the £1000 mark

and is all up to date and on track for being paid off within the agreed time,

they were also very accommodating last christmas when i requested a skipped payment that i could pay back gradually on top of my usual monthly amounts,

the balance was back on track in 3 month with no threatening phone calls or letters.

obviously i'd be happier if i didn't have to pay this (which a previous solicitor said isn't an option unless i want a bad credit rating)

but as far as DCA's go they're very pleasant to deal with.

well ofcourse they'll be nice to you if they are fleecing you.

pays their dinner money and after work booze

where they go and laugh about all the people they are cash cowing.

i''l move these posts to a new thread

so's we can all deal with it.
