Hi,straight to the point..i have found MKDP LLP on my credit report stating i have defaulted a loan in 2010,and that the loan was taken out in 2004.Heres what I DID!!I bought a car in 1999 using welcome finance and the loan was for 5 years.I payed for a year then defaulted,young and foolish.After 6 months or so i offered them £25 a week which they refused and took me to court.The court put an attatchment on my earnings of £20 a week...yes,i know...i cant be sure if i payed for 4 or 5 years or maybe even more.I then changed jobs and heard no more of it until,again foolishly,i tried to claim back £1500 i know i had paid for PPi(the car was £3800 and the total i had to pay back was £7500 because they put ppi in and charged me interest on it too!).Anyway i didnt get anywhere as after i paid for a statement of accounts,Welcome informed me they no longer had any records of the account.2 weeks later i get a letter from a DRA stating i owe Welcome £1500!I moved house a month or so after.I have just got my credit record and found the debt on it as a 2010 default,when i know the last penny i paid was from the job i left at the end of 2006!!I have been screwed over and over by Welcome,my own fault of course,but i know that this record is untrue and not fair!!PLEASE HELP!!

If the CCJ was granted against you, then this takes precedence on your credit record. No other entry can be made for this debt.

 

Lets see if i got the timelines right.

 

You bought a car in 1999 with a 5 year finance deal. So it was due to end in 2004.

 

You paid for a year, so the default was in 2000.

 

You then had a CCJ granted against you. When did this happen?

 

You paid the CCJ for 4-5 years. If this commenced upon the default date, it would have been 2009 at the earliest.

 

You tried to reclaim PPI. WHat was the reason for you not getting this back? Did you have all statements? The PPi would have easily written off this debt and left you with some extra cash.

 

 

Then in 2010 a default was added by a DCA. This default is erroneous and not correct.

Hi again nicky. It looks like the DCA has entered this default, possibly to try and stop it becoming Statute barred. The CCJ, as i said would take precedence, and if it was granted in 2001-2002 then the debt should NOT be on your credit record. You say that you paid for 4 years and the CCJ was in 2002 at the latest. This means that you stopped paying in 2006-2007. Pretty much 6 years ago. Nobody has chased you since, so i very much doubt these con artists can do anything apart from harass you.

 

I've sent a PM to the main guy on the forum who deals with the credit agencies and knows a lot about DCA tactics. Sit tight and hopefully he should be able to respond today or tomorrow :) He can give you a nice letter to send them that leaves them in no doubt as to your stance.

There is no time limit on PPI reclaims if you have the statements to show the PPI.

Why use a PPi claim company when you can do it yourself? A PPI company will take a minimum of 30% off you, for sending 2-3 letters you can do yourself. You would have gotten something easily. You were just fobbed off by welcome and fell for it. Welcome always do this. They are/were the lowest of the low.

You need all statements. If you dont have them, you would need to SAR welcome. When you have the statements, we can give you a spreadsheet. Enter every single PPI amount on the sheet that you paid, and enter the interest rate they charged you. At the bottom of the spreadsheet there will be a total amount. That is the amount you would be claiming.

OK a CCJ say latest to 2002 MKDP have no chance of getting this reopened.

When exactly was any payment made to any party on this account?

 

A SAR to Welcome should be the next move, does your credit file still show any entry by Welcome?

 

We need to establish the date that Welcome sold the debt on, then it would be easier to challenge the unfairly late default placement.

 

I think we can successfully get this removed from your CRA files, just easier with the information requested above.

The last payment made to welcome was December 2006,it was for roughly £20 (cant remember the exact figure),and it was taken directly from my pay.I have never paid any money to MKDP nor have i respondeded to any correspondence.There are no records of Welcome Finance on my credit report.My credit report says,the account (with MKDP)started 6/12/2004,and that i defaulted 1/1/2010.Hope this is all the info you need.

Hi Nicky,

 

Which CRA did you use?

 

There is definitely something wrong here, so first job is the Subject Access Request ( SAR ) to Welcome, statutory fee is £10.00

 

there is a template in the CAG library for this and Welcome have 40 Calendar days to reply.

 

Use a cheque or postal order for the fee and mark it clearly 'FOR STATUTORY FEE ONLY'.

 

I suggest recoded signed for post.

 

Welcome got the CCJ in 2000/ 2001 correct? If so we have they ammo to blow this out of the water NOW, for the CC claim to be made the account would have been defaulted and terminated prior to the court action.

 

So I will compose a letter to challenge this for you over the weekend, the SAR is still essential to help with the PPI.

No problem, Welcome and associated debt purchasers seem to have some kind of 'deal' with Welcome defaulting account just prior to sale or selling on debts without defaulting them at all.
