please help. my lodger has been to court and we are expecting the county court bailiffs..

 

the debt collection company was arrow global,

 

who told lies to the court saying that my lodger owned my house

 

my husband who was in court told the judge that was wrong,

 

the judge said that's irrelevant.

 

how do I stand with this

 

do they have the right to come into my house and remove my belongings,

 

this is to do with my lodger not me or my husband.

please help I don't know what to do.

No they dont have any right. Mke sure all doors and windows are locked tonight before tomorrow.

 

Has the lodger left? If not give him notice to leave, 48 hrs should be enough.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Statutory Declaration to the effect that the named debtor is NOT the property owner, has no proprietary interest in any goods and chattels at the address, has the status of lodger only, copy to the court, and the bailiffs, and creditor.

 

Also tell the bailiff you have no intention of allowing them any form of entry peaceful or otherwise, as you have or are evicting the lodger.

What type of debt is this ?

 

If the lodger deals with the CCJ, there will be no use of bailiffs. Not sure why this thread is in the bailiff folder, as Arrow Global are nowhere near a position of using bailiffs. It could be many months or years before that happens. If it ever happens !

You need to ensure that you speak with the lodger to ensure that he deals with this matter. There are simply thousands of Judgments each year and the ones that go to a bailiff are typically where the debtor has FAILED to address the matter by not paying or alternatively, if he or she cannot afford to pay by completing the N245 form to VARY THE ORDER.

 

It is also most important to ensure that you have a Tenancy Agreement in place which should record which items of furniture are included in the tenancy.

A quick check of the Land Registry would prove to the court and Arrow Global that the Lodger was not the owner of the property.

 

You should also consider having the locks changed if you have now evicted the Lodger.
