Hello,

 

Thank you for reading, apologies if I’ve posted in wrong forum section.

 

Experian have been reporting since 04/10/07 a Welcome finance loan amount £2500.

 

with a balance of £8332 for the first 4.5 years up until a year ago when it changed to £3990 its current balance.

 

I've never paid any payments towards this loan ever or made contact and thought is was in fact taken out much earlier in the year 2007?

 

The account has been reported as
delinquent
i.e. 6 markers for the last 5.5 years.

 

Since 30/04/13 the account has been updated as in default, this would mean being reported to Experian for 11.5 years without any contact.

 

The default was placed using my previous address according to Experian.

 

Any help how to deal with this mess would be appreciated.

 

I'm aware I should have paid at the time but I’ve only recently been able to deal with it.

sorry just to be clear

in the summary of the debt

its defaulted date is 30/4/13 or is that the updated date?

 

its welcome that report it not the cra.

rock and a hard place then

 

if you owe the money [though most welcome debts are vastly inflated by penalty charges and all manner of insurances, that can all be reclaimed]

if you complain, then the bal becomes an issue

 

we could try to get the default date amended, that is unfair

I'm trying to obtain a mortgage with my wife at the moment, - however my bank utilises CRA Equifax and this account does not show with them.

 

I receieved an alert last week informing a change to my report ie account status changing from delinquent to default 30/04/13

 

I've been working through my CRA files paying, tidying up for the last 3 years and this Welcome account is the last one.

 

I'm just eager to get a clean credit report.

 

How can i SAR without a account number can i get this from Experian?

ok all good now we know.

 

you don't need an account number to sar them

 

its for PERSONAL details they hold, not like a CCA [we'll do that one poss later]

 

have you read a few welcome threads to see what they are like?

 

it might be an idea to get the brig onboard here

 

if we can get the default moved to say the 2nd or third missed payment date [

then it might be better and fall off soon.

Sorry I haven't sent a SAR letter before,

Yes I would very much like to get the default moved to correct date.

I've had a read through a few accounts similar to mine, some went quite well others seemed to open up all sorts of problems.

Please bring on the brig. I really do not know how to move forward.

Hi looking in as requested by dx100.

 

Am I correct in thinking this account is still with Welcome and no DCA is involved?

 

If you have never made any payments on a loan taken out in October 2007 the default should have been placed within 6 months of that date and no later, although this does not surprise me, Welcome and accurate paperwork are not synonymous.

 

I've seen quite a few similar cases recently and they have proved be the precursor to selling the account to a debt purchaser with a nice long 'default life' for the to pursue the account, this appears to me to be deliberate manipulation of the data, the default is clearly unfairly placed, it should not be 'updated but should be removed completely!

 

I will put a letter together for you a little later this morning.

Welcome Finance.

 

Formal Complaint:

Unfair Placement of default/misuse of Credit Reference Agency File Data.

Sir/Madam,

I have recently been alerted to changes being made to my credit reference files held by xxxxxxx credit reference agency.

Welcome has caused a default to be placed on the loan account ( I enclose a screen print of the entry for your information and clarity).

Welcome Finance must surely be aware of the Information Commissioners Office Technical Guidance on Defaults and the statement that ''DEFAULTS SHOULD BE PLACED WITHIN 6 MONTHS OF THE CAUSE OF ACTION, usually considered to be 3 missed payments and no further payment being made.

Therefore placing a default after 5 1/2 years that is on 30/04/2013 is manifestly unfair and unreasonable and indicates possible manipulation of the default system allowing Welcome Finance to extend the ''life of the account'' perhaps facilitating the sale/assignment of the account to a third party.

I require Welcome Finance to take the following action:

To remove ALL adverse data relating to this account ALL credit reference agency files to which this account has been reported and to confirm in writing that it has done so.

Should Welcome fail to comply with this instruction a formal complaint WILL be made to the ICO and the

matter WILL be reported the OFT/FCA and I will put the matter before the Financial Ombudsman Service, this will of course in some cost to Welcome Finance.

For clarity and the avoidance of misunderstanding, Welcome Finance appears to have unfairly and unreasonably to have deliberately manipulated credit file data by placing a default entry 5 1/2 years after the cause of action in what appears to be an attempt to extend the ''life'' of this account.

Welcome is required to remove all adverse data and confirm in writing that it has done so.

Finally this communication is NOT an admission of liability for any alleged debt to Welcome Finance.

please us RM recorded/signed for post and check receipt, this is a formal complaint that MUST be replied to within 56 days from the date they receive the complaint.

Thank you guys so much, I'll get this in tho post tomorrow.

I believe the debt has been sold to MKH as i've been receiving calls daily for the last 2 weeks, I've not answered any of the calls.

The debt shows its with welcome of CRA file though?

Send to Welcome, this sounds like more sloppy admin if MH have acquired the account they should update the credit files.
