Hi

 

I went to my bank on Saturday and noticed that capital finance had taken out 2 lots of £21.84 payments and a £25,

 

my husband had a payday loan with CFO but cancelled the card so payments would stop as we couldn't afford it and

 

now it looks like this company has my details and taking money

 

can anyone tell me if they are same company as tried calling them, but they won't talk to me and hubby is at work please anyone let me know ASAP

Have you applied for a further Pay Day Loan. It is my understanding that PDL companies that operate under more than one name will do this.

 

If you have not given permission for this company to take money from your account you need to ask your bank to do a charge back.

I don't know if he has I am going to kill him when he is in from work!!! Do u know if my bank can stop them from taking money I am with Clydesdale Bank and thy aren't being very helpful

I am pretty certain that you would just need to drop a letter into your Bank saying that you have NOT given this company permission to take money from your account.

We have been telling people to put a letter into their bank instructing them not to make any payments under any circumstances to these companie

Cancelling a regular

card payment:

 

When you give your credit or debit card details to a company and authorise them to take regular payments from your account,

such as for a gym membership or magazine subscription,

it is known as a ‘recurring transaction’ or ‘continuous payment authority’.

These are often confused with direct debits, but do not offer the same guarantee if the amount or date of the payment changes.

In most cases, regular payments can be cancelled by telling the company taking the payments.

However,

you have the right to cancel them directly with your bank or card issuer by telling it that you have stopped permission for the payments.

Your bank or card issuer must then stop them – it has no right to insist that you agree this first with the company taking the payments.

Be aware, though, that you will still be responsible for paying any money that you owe.

Regulation 55 of The Payment Services Regulations 2009:

55.—(1) A payment transaction is to be regarded as having been authorised by the payer for the purposes of this Part only if the payer has given its consent to—

(a)the execution of the payment transaction; or .

(b)the execution of a series of payment transactions of which that payment transaction forms part. .

(2) Such consent—

(a)may be given before or, if agreed between the payer and its payment service provider, after the execution of the payment transaction; and .

(b)must be given in the form, and in accordance with the procedure, agreed between the payer and its payment service provider. .

(3) The payer may withdraw its consent to a payment transaction at any time before the point at which the payment order can no longer be revoked under regulation 67.

(4) Subject to regulation 67(3) to (5), the payer may withdraw its consent to the execution of a series of payment transactions at any time with the effect that any future payment transactions are not regarded as authorised for the purposes of this Part.

This means that you can simply ask your bank to refuse the payments, it is also good practice to let the lender know too.

So, if you would like your creditor to stop trying to take a payment all you need to do, in theory, is to inform them that you remove their authority. It's probably better to do this in writing and via recorded delivery - if possible.

Ending recurring payments from credit cards

57 Recurring payments, is the term used to describe transactions for which a client has granted written permission for her/his credit or debit card to be debited for recurring goods or services, for example, club membership subscriptions, insurance cover or payday loansicon. The card may be debited annually, monthly or at other regular intervals.

58 In most cases, recurring payments can be cancelled by telling the trader taking the payments. However, a client has the right to withdraw consent by simply telling whoever issued the card (the bank, building society or credit card company) that s/he does not want a payment to be made. S/he can tell the card issuer by phone, email or letter.

.

59 The card issuer has no right to insist that the client ask the trader to stop taking the payment first. The card issuer has to stop the payments if the client has asked them to. The client could point out to the card issuer that they should follow the FSA guidance available in the FSA know your rightsicon booklet which is available on the FSA website at www.fsa.gov.uk.

.

59a If money is still taken from the client's account, it will be deemed to be an unauthorised transaction, and the card issuer must give her/him an immediate refund. The card issuer will have to cancel any interest and charges added to the her/his account because the payment was taken. It is not up to the client to prove that s/he told the card issuer to stop taking payments. Instead, the card issuer would have to prove that s/he did not tell them to stop making payments.

60 The client should make a complaint to the Financial Ombudsman Service when all the internal complaints systems within the company issuing the card have been exhausted.

Are they taking money from a different card/bank account to that of your husband's i.e. do you have a different bank account number and debit card number to your husband's?

Report the bank to the oft and fca. Exhaust the banks complaints procedure and get the fos involved

If you have never given them your card details, or permission to use the details, then they have taken the money fraudulently - call your bank fraud department and report it - tell them you have never had any dealings with these people (which is the truth, it's your husband who has the account with them) and you want the transaction cancelled and money refunded to your account.

 

How on earth did they get your card details ?? have you used the card online recently for anything at all ?

Thats what i was thinking, no only got this new card in April aswell!

 

I called CFO and they said if it was them taking the money out it should come up as capital finance one

but the bank says it capital finance

 

- can anyone let me know if theres said the same and if it was CFO taking money

On my mini statement it says it was a card authorisation so if i cancel my debit card wil it stop them from taking any money?

its just another of their ruses to fool people/spoof money out of them

 

have a read of this forum

 

you'll see they use a fake solicitors name

and

a fake / closed dca name now too to do the same.

How can they continue to take money if i cancel my card :-(

 

its a CPA against the bank account not the debit card.

 

cancel the CPA In writing by RD to your ban

demand the payments back.

I have affixed a letter to take into your bank in the morning - you need to put your address, the banks address and your account number in it. Then you both sign it. Take two copies with you and get them to sign one to state it has been received - you need to keep the copy with their signature for receipt in a safe place - you may need to wave it at the authorities if they don't comply with it.

Thanks for that, will hand that tmro, jusu called CFO & it was them taking the payments, now set up a payment plan & have frozen the card they were using. Anyone had ok experience with them & payment plans?

You called CFO? SOrry to say, but be ready for more trouble ahead. You must NEVER phone them. ALso, the ONLY way you should be paying them is by standing order. No other method is scure.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hang on a minute - they took money from your card when you didn't give them the number or authorisation to do that. You need the money refunded to your account.
