      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've got a small claim ongoing for PPI from an old egg CC.

 

They keep telling me they need proof of my new address to send the cheque out, this being bank or building statement

gas/elec bill

council tax bill

(all dated within the last 2 months)

 

I don't bank in paper other than CC's

The gas/elec bills are both online, and if i do have a paper statement, its like 6 months old

the council tax is in the wifes name.

 

Last time i send them the following, hoping it would suffice

A copy of my UK firearms cert

A copy of my UK shotgun cert

my last virgin CC statement

a copy of my driving licence

 

Now forgive me if i'm wrong, but surely these 4 items prove its my home address. The home office don't give out firearms tickets without some pretty serious checks !

 

Any ideas how i can move this forward?

These people are ridiculous. I have exactly the same problem however I sent them an original of my gas bill 3 months ago for an SAR request.

When I finally obtained it, the SAR has actually got some sort of verification sheet signed off by a member of staff with regards to my address.

I obtained from the SAR all the details to start a PPI claim, send it off, only to receive a letter saying that they need proof of my address, even though they sent an SAR to the same address.

So I send them a letter with the proof that they already have it, even sent proof of the verification signed by their member of staff and today I get another letter back saying we need proof of your address.

 

I am getting very frustrated with Canada Square, there is no number to ring them on, and when you write to them you are lucky if you get a response within 3 weeks. Their delaying tactics are shocking. Short of sending yet another gas bill which they do not even bother to return I don't know what else to do.

Not sure if or who I can report them to. :-x

a printout from any util site should be ok

 

as well as a printout from voters.

 

di'd suggest they check voter themselves too, they have access to it!

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Of course they have it! It's just an excuse to try and put you off making any sort of claim with them.

The fact that they won't even acknowledge their own acknowledgement of my proof of address makes it unlikely they will check the voters register as surely they would do that anyway?

Looks like I'll have to send yet another original gas bill which will solve the problem at the moment but I don't really see why I should when I'm not going to get it back.

send a scanned copy and a recent bill printed [via the pdf download] from the util site
