      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

My minicredit loan is due tomorrow. Like others I find myself unable to pay. My hours at work have been cut by half and we are being paid cash so I have no funds in account at all.

I emailed minicredit 3 days ago advising them all this and requesting a repayment plan for the loan plus 1 months interest.. Same email again today. I have had no reply as yet. What do I do now?

Secure your bank account. They WILL try and clean it out then ignore any correspondance.

I've cancelled my card already, basic account and no overdraft and have a zero balance.

 

Do I just wait for them to start mithering me or shall I send them more correspondence?

Cancel the cpa or the bank will let them take you into an unauthorised overdraft

Yep. Plenty of banks do this. Remember, a basic account is a normal account with all the extra's deactivated.

 

Get the CPA cancelled and have a read of Regulation 55 of the payment regulations 2009.

Nope. Ring the bank up and tell them. Go higher and higher up the chain if they try and fob you off. By LAW they MUST follow your instructions:

 

Regulation 55 of The Payment Services Regulations 2009:

55.—(1) A payment transaction is to be regarded as having been authorised by the payer for the purposes of this Part only if the payer has given its consent to—

 

(a)the execution of the payment transaction; or .

(b)the execution of a series of payment transactions of which that payment transaction forms part. .

(2) Such consent—

 

(a)may be given before or, if agreed between the payer and its payment service provider, after the execution of the payment transaction; and .

(b)must be given in the form, and in accordance with the procedure, agreed between the payer and its payment service provider. .

(3) The payer may withdraw its consent to a payment transaction at any time before the point at which the payment order can no longer be revoked under regulation 67.

 

(4) Subject to regulation 67(3) to (5), the payer may withdraw its consent to the execution of a series of payment transactions at any time with the effect that any future payment transactions are not regarded as authorised for the purposes of this Part.

Just a thought...I have another account with the same bank. If some money goes into that one can the bank move my money to pay Minicredit straight away or will I have time to withdraw it? Terrified of waking up in the morning and being overdrawn!

You can if you want. The bank may and offset the other account. Its not normal but its not rare.

As I haven't been able to discuss with my bank today I have sent an email requesting the CPA to be cancelled with the company as I have not authorised them and also that should payment be taken even though I have cancelled my card, then I will require a full chargeback so I can continue my dispute with the relevant company. This ok?

Also, if I go and close my account, is it done immediately?

So they got your instruction. Thats all that matters. They can demand you go into a branch.

Hi again,

 

Money not allowed to be taken from my account, subsequently I have received the standard default email from minicredit saying they have added 25 charges on and will add another 55 on 16 May should I not pay. Do I ignore them or send yet another email to them requesting a payment plan?

You owe a single default charge. Nothing more. However, it must be a default charge and not a late payment penalty fee.
