      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi and welcome to CAG, very sorry to hear of your miscarriage.

I dont know much about baytv but im sure someone will be along with the right advice soon.

 

Do you have a copy of a contract with their T&C's on the back and does it say anything about removal.

 

Also do you have a price on it to say how much the TV cost to see what percentage you have paid in relation to its value,

i'm assuming its an agreement to buy and not just to hire.

I think all the experts have gone to a BBQ, tbut i'm sure they will be along shortly.

 

Had a quick google on CAB site and it says,

When can the lender repossess the goods

 

If the lender ends the agreement, for example, because you haven’t kept up with the repayments, they may be able to repossess the goods. Usually, the lender will need a court order to do this. But if you’ve paid less than one third of the total amount, they don’t need a court order. The agreement should tell you how much one third is.

 

You have paid half so he shouldnt have taken the tv, paticularly in view of you reporting the fault, and more so because of your sad misscarriage. What a nasty peice of work they are.

Have you thought about going to CAB tomorrow and did the moron leave a copy of what your friend signed.

I certainly hope heads roll at bayv after you have complained to them, the attitude of some of their staff stinks, particularly when dealing with someone in distress like yourself. God it makes me angry, wouldnt like to say what i would do if something like this happened to my daughter.

LoL, thats fine ims, would have done the same given the chance, just been trying to keep poor rebeccas spirits up, she really has had a very bad experience in more ways than one.

The kettle lead. The manager has been told by the collector that a wire had been detected at the back of TV and this wire may have been used to by pass the box timer, if this was true a kettle lead would have been stripped at both ends this is a crude way of doing this action, unless, that was the only available cable at the time. Anyway the manager reckons this is a good reason for grabbing the tv back,

even that you have paid. £800

 

Just shows how desperate these morons are to get their goods back picking on helpless people with excuses like that to resell them, i dont think a customer would report a fault with the box while they were bypassing the box. Beggars belief.

exactly, the box had jammed some how so i couldnt put anything into it, if i was somehow trying to con them i would have removed the fault :/ its just awful that they are trying to make me out to be the bad person. I wish i had been here so i could have taken pictures before he had removed it x

 

From what ive read youve done the right thing, even having your friend to be there to explain the situation, maybe that wasnt such a good idea after all. But then again with the benefit of hindsight we would all be in a diff situation.

You did the right things keep telling yourself that and direct your dismay to the staff (did i say staff) and not yourself.

Good advice from dx, so let's see what happens tomorrow first. Personally in your condition u don't need more stress and upset. If its not resolved in the morning to your complete satisfaction I would let TS take a load off your mind.

Hi guys just letting you all no that I've spoken to Elaine (she was a very big help) and we are pretty much sorted now. After alot of misunderstandings Elaine has sorted it, I am paying the £65 I owe them off and then my tv is being brought back. Thank you all for your help I'm very pleased with the out come :) xx

They really are paying hardball with you, i would have thought,, no not thought-- EXPECTED, in view of their behaviour to have at least done something like dx said in #44.

I would still go for them when you get your telly back, and of course when your upto it.
