Large envelope arrived yesterday from mbna, consisting of

16 pages of comms log main.

14 pages of additional comms log.

8 pages transaction record.

1 double sided page of autoscore sm card application details.

1 double sided application form.

3 pages with tacs superstation-non call maintenance screenshots.

1 page abbreviation key. 2 page glossary.

1 page re;subject access request.

 

No correspondence,

no default letter and most of the stuff sent is all abbreviated or in code so gobblydegook to me.

 

The transaction history is pretty useless, as it does not show a balance after any transaction.

Plus i can see some strange 4 and 5 figure payments apparently made to them, and balance transfer numbers which i believe are impossible .

Also it never states where the balance transfers are from.

Link have failed dismally. I told them 3 times what i wanted, they just sent the same stuff in email as they sent through the post.

What do i do now ?.

Ok, you have been supplied with a key to the abbreviations and a glossary of terms to enable you to understand what you have received.

 

Link would not have any data prior to their acquisition of the debt.

 

As to the 'default notice' these are not routinely archived ( no obligation to do so) a note is made on the creditors file that a default notice was sent on a specific date.

 

 

Reading through all this I cannot think there can be any more data for you to get, what exactly do you want from them?

Hi BRIGADIER2JCS, thanks for joining in.

 

The key covers very little, and i am hesitant to attempt to guess what all the abbreviations mean.

 

I have not asked link for anything before they owned the debt. It states on the notes that they sent me several letters, but dont say what these letters were concerning, and have not sent me copies. Surely i am entitled to know what these letters are about ??

 

I have an old equifax file that says i was defaulted in 2006 for this debt, but i also have a default from link dated 2008 for the same debt ???.

 

I cannot find on any of the notes or stuff from mbna, anything to do with the default.

The letters link mention will I expect be 'generic' debt collection letter (threatograms) which would not be archived (these are the usual we may, we might, letters).t

 

The default dates shown are of concern, there can only be one default date, this could be the date Link acquired the account, but the date should remain the same and the creditors entry should be removed.

 

What is on your credit files now?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Mbna defaulted me and sold the debt to link in 2006. The default was listed on my credit file dated 2006. The default letter from link was dated 2008, two years after they aquired it. I have only recently learned that mbna repurchased the account in 2009.

My credit history is now clean, with no nasty stuff on it.

I presume i have all i am going to get from both companies. My head is spinning with all this paperwork.

Thanks for all the help up to now. I have done the SAR requests as suggested.

What exactly am i looking for to help me to make this all go away, what do i need to do next ??.

Link CANNOT issue another default on the same account, but as this is NOT on CRA files now is LINK chasing the debt again if so I can draft a letter to sort this.

No link are not chasing me, they have recently told me they dont own it anymore as mbna repurchased it in 2009. link have repaid me the money i paid to them since 2009. Mbna have not contacted me to tell me they have owned it again since 2009. neither link or mbna told me it had changed hands.

Thats the best thing i have heard for a long time.

 

But before i get too exited, please please explain in more detail what you mean by that. Are you saying that mbna cannot come after me now,. Or are you saying that if they do i can do something about it.

Its a concern to me because nobody has told me this debt is officially dead.

Im worried they are gonna start giving me grief again. I would obviously like it to be officially dead.

I wish i could just forget about it, but i do worry and lose sleep over this stuff.

why worry of a non event, if you had been contacted then one could see why the worry - and we could deal with it, but all the signs are that nothing is happeneing!

 

Tell you what change places with us? we would love to be in your sitaution.

 

They will not tell you only in exceptional circimstances may be. so let it lie.

You can forget it now, even if it did crop up again it would be easily dealt with!!
