Mini car Finance Agreement & Payments Different

Hi all,

 

A friend of mine bought a car last year from a local Mini branch. He applied for finance and he was accepted with no problems. He then got his copy of the agreement after it had all been signed up and it had his payment breakdown on it (as it does).

The agreement stated that he would have 60 months fixed payments of £68.00.

He then got a summary but never looked at it (well until now). The summary states that his payments are 60 months fixed at £71.55. He has checked his bank account and sure enough they have been taking £71.55 out of his account.

 

This is the agreement that was signed by both parties:

and this is the summary which states a completely different monthly payment plan

 

Summary Of Agreement

 

From my workings the original price would be 60 months x £68 = £4,080.00 to be paid.

The summary version of the price would be 60 months x £71.55 = £4,293.00

The difference being £213.00 EXTRA!!

 

What is the best course of action for this? Surely they are in breach of contract if they agree a price and then start charging a higher and unjustified amount.

 

Any advice would be greatly appreciated

I must be taken up with the Finance company directly, no doubt they will be an answer from them.

So contact Mini Finance and see what they have to say for themselves?

If they say it was an error and re-adjust the figures so that it is correct (and the final figure is £4,080) then i guess this will be OK.

But what if they say no the payments should be £71.55? Surely they can't so this as the agreement states otherwise. What if this had never been picked up? Are Mini then essentially ripping customers off?

No problem, I guess its only fair to give Mini credit the chance to rectify their mistake. Will keep you posted.
