after sending 2 letters to BOS they finally replied saying that the OFT's inquiry about unfair charges only covered credit card companies and not business bank accounts, which was what i had.

any comments would be appreciated to help me recover £3500

Dont worry they are trying to fob you off, the only difference is that you are not relying upon consumer law as an argument, common law you are. When you issue a small claim which I gather is your next step you simply omit the reference to consumer law from your particualrs of claim.
