      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, i posted my spreadsheet to the Northern Bank (NI) on 9th Oct which they received on the 11th Oct. I stated that they had 14 days to reply to me: "accepting, unconditionally, my request in priciple and letting, me know a date by which i will receive payment".

 

I received a letter back from them dated 11th October & received by me on the 12th October. It basically said that they received my letter on the 11th October & thanking me for bringing it to their attention. They said the matter would be investigated & that when these investigations were complete they would respond to me - usually within 20 working days. They also said i could refer the the ombudsman if i wasnt happy.

 

Now, what i want to know is, can they make me wait 20 working days as i gave them 14? Do their 14 days start when they receive the letter? What is my next step from here? Cheers all, hope someone can help :???:

no you stick to your timetable, give them an extra couple of days as the court assume 2 days to receive the letter.

the thing to remeber is YOU are in the driving seat-not them.Do not let them dictate terms or timetables to you-if you hand them the initiative,they gain the advantage.

 

And open a parachute account if you haven't already.They paid me £2888 in claim 1 and closed my account.Now I have claim 2 pending for an estimated amount,because they are withholding my data prior to 2004.

 

A VERY vindictive outfit-never forget that!!

Did they pay up because of your letters to them or did you go to Small claims court. My understanding is you can only claim a max of £2000 through the court. I have sent lba to northern bank on Tues 10/10. Trying to get £2300 of them. As previously mentioned in this thread the bank promised a response within 20 days but that deadline passed without a cheep. Cant wait until the deadline.

they paid up because I harassed the arses off them.I had filed a claim,and they eventually paid it,plus all the charges I had accumulated post-claim......the final straw came when I exercised my "right of appropriation" of benefits not to be used paying charges,and to actually be allowed to keep us alive!!

 

dummy right out of the pram time-account closure plus payout!!

 

Now I'm going after any charged pre-April 2004.They have refused to give me this info,but have given everything to another claimant right back to 1999.....wonder how they are going to defend that!!???

Thanks all for your help! Is there a template around anywhere or can anyone help me out with something to say to them along the lines of "no, you have x amount of days & not 20 working days to respond to me weather you are going to pay out". Cheers all ;)

Thank you very very much! I have my LBA letter typed up ready to go, as i doubt they wil get back to me within the 14 days. Thanks again! Looks like ill be needing help with court stuff soon! lol!
