Well done.

 

When are the Judges going to stop Lowell abusing the insolvency proces ? There must be discussions going on about this, as Lowells or their reps appear to be in court now on a regular basis. At some point I would guess that Judges are going to say enough it enough and look to stop them.

We could do with some help from you.

The problem is that people on CAG are getting help in seeing them off successfully but there must be dozens of people out there who don't know how to deal with it, and therefore Lowells must be getting some successes in Court. Throw enough ..... and some will stick. So for every case they lose there must be several they are getting away with. :-x

That's why it must be brought to the OFTs attention as 42man states.

Back again! I have recently started to receive phone calls again from Lowells (which I have ignored) then today I received a letter from Hamptons chasing me for the same debt which was set aside in February. The letter says 'We note that Lowell financial Ltd. have offered you on a number of occasions the opportunity to enter into a payment plan so that you could clear the account but you have decided not to take up the offer. We know of no reason why this debt should not be paid and can only assume you simply have no intention of paying it back. If you continue to refuse to pay, we will consider the following:

 

Applying for an Attachment of Earnings order

Applying for a Charging order

Issuing a petition to the court for your bankruptcy'

 

What do I do now?!

They'll "consider ....."

 

Not they "will"

 

For the first two : they'd need a CCJ.

For the latter they'd need to serve you with a valid Statutory Demand (which they tried and failed!)

 

If they can't produce an enforceable agreement : none of these will be granted if you oppose / set aside each time.

You could send them a very polite letter pointing out that on DATE a Stat demand issued by Lowells was set aside by Judge XXX. That the Judge pointed out that the agreement was unenforceable !

 

For their reference you could provide them with the Court references and suggest they refer back to their Client.

 

You should also advise that, having already made a complaint to the OFT, that you will be forwarding a copy of their letter to the OFT to add to that complaint.
