Hello all,

 

I defaulted on a credit card with Lloyds a few months ago,

I have been struggling with money for the past year,

 

MH collections have contacted me saying I have to pay the £1400 back for the credit card within 10 days or legal action will be taken :( will yet CCJ me for this??

 

I written to them offering £15 for 6 months Untill I can find a job and start paying it,

they have refused saying its not enough, and legal action will be taking place If I don't pay it what?

 

£15 is the max I can pay as other debts need to be paid before this!

 

Any ideas guys??

 

Will they CCJ me or keep passing the debt around???

Yes I'm out of work

but I am due to start at job on 3rd dec

 

I have dealt with can before

 

but feel try where useless in my cause,

 

I'm going to write to MH saying if they do not accept my £15 a month then they will have to take me to court it's as simple as that,

 

I'm just a bit scared about getting a CCJ, t

 

he card was taken out in 2007,

 

I have had it maxed out and paid off no end of time

 

ive not paid anything on it since June

 

anyone know if they will take me To court???

 

I want to pay it but just carnt Untill I start work!

 

What can they actully do to me???

If it was taken out before 6th April 2007 then CCA them. (Request a copy of the agreement under the Consumer Credit Act 1974). Even if it was after it is probably still worth doing this.

 

If they fail on that (and it is quite possible they will) then they cannot get a judgment in court. No CCJ. It is well worth £1 and a letter to find out.

is this MHA Collections? they are loyds 'internal' debt collectors ie the same as their 'collections' dept except with a different letterhead.

after MHA is BLS collections (also loyds) if they still do that, then likely out for external collection with likes of robbing way, wetcloth, lesscroft, csl, etc either on instruction or sold.

If you have paid nothing they will probably follow through, though not for a while.

Try to pay just £1 a month and stick to it.

my other half has been doing this for 2 years. also ask them to stop interest and charges.

Just to stop paying will only cost you more in court costs and fees.

i'd read the letters properly....

 

they do NOT say WILL

 

every word but

 

if, might, could, instruct etc etc

 

MHA are the next bloke at the next desk wearing a diff skirt.

 

if you not got all the statements

 

get an SAR off to lloyds and get reclaiming £12 PENALTY charges & PPI?

 

also

 

dont ASK them to accept £15 TELL THEM.

 

tell them they are only going to get £xxPCM for xx mts

as a goodwill gesture

and as a reciprocal GOGW they must freeze int & refrain from levying PENALTY charges.

if they wont

drop them to £1PCM for life.

then pay by your internet banking site

and get reclaiming

i'm sorry, but you have failed to assist me during a period of financial difficulty, against all the guidelines and codes

issued by the relevent bodies and authorities that govern you and the way you conduct yourselves.

i repeat again, the contents of my letter dated dd/mm/yyyy, for want of clarification:

to show my goodwill, i am going to pay £XX for XX mts

could you please as a reciprocatal goodwill guesture, refraining from levying any penalty charges & freeze the interest on my account.

i will update you in 6mts time or before, should my situation chance.

should you fail to help by refraining from levying unlawful PENALTY charges & freeze my interest,

i shall have no alternative but to reduce my offer to £1PCM for the rest of the life of the account,

as your actions are doing nothing to help me.

This is contrary to the rules you should operate under.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
