Hi to all.

 

For the past year I've been making minimum payments of £1pm to Link Financial for a Barclay's bank cc card which is reviewed every 6 months.

 

I've sent them a budget set up online with CCCS which they ignore.

 

They called me today to go through my income/expenditure and now want a copy of my benefit letter. Do I need to send this to them? If I don't what could happen?

Hello there, you don't need to send it to them; they should accept your I/E form at face value. If they continue to press you then request their complaints procedure and consider a formal complaint to the FOS.

 

Do you have other debts? How much do you owe in total? Also are you in rented accomodation?

Thanks for the reply sequenci. In total I have 10 creditors owing about £65000. I am on ESA benefit and pay them £1pm each. I own my flat and pay mortgage on it. One of the creditors Nationwide has put a charge on my property and issued me with a CCJ. They all ignore the budget I set up with CCCS and insist on doing their own over the phone. The most helpful creditor has been Marks & Spencer.

When my problems started in 2006-2007 (before I discovered CAG) M & S were one of the few creditors who refused to accept the pro-rata payment initially offered and insisted on a minimum of £5.00 per month which I thought I had to agree to in order to keep the wolf from the door. Although they initially seemed more friendly on the phone than most of the others, when the time came that they decided £5.00 was no longer acceptable and wanted more than I could pay, they ended the arrangement. It was then that I CCA'd them and they started threatening court action.

 

So be warned, they'll probably turn on you in the end just like the other creditors.

 

In my view I just prolonged the inevitable by agreeing to their demands and paying more than the pro-rata amount (which incidentally was over £1.00), and furthermore I now realise that I have prolonged the date when the alleged (unenforceable) debt will become statute-barred rather than if I hadn't paid anything.
