      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello!

 

I am very new to this but would really appreciate some advice.

 

I have already made a successful claim to MBNA and others that are being assessed for mis-sold PPI but this one is hitting a brick wall!:!:

 

I am trying to make a claim for mis-sold PPI by First National Motor Finance.

 

I originally sent the claim to Santander but they are saying that they have no record of the loan agreement which the PPI was atatched to.

 

Having "Googled" for many hours I am now wondering if I should be pursuing the claim with Santander or submitting the claim to GE Money or London Holdings Limited who were the contact in the event of a claim under the policy.

 

Can anyone help me with this?

Do you have any paperwork for the agreement to which the PPI related to ?

What period are you talking of ?

Have you got any statements from the period for MBNA and Santandar which might show something ?

Thank you for your reply.

The agreement was taken out in June 2003 and I have a letter from First National Finance outlining a telephone conversation and an agreemnt to take out PPI on the First National Motor Finance Loan which started in May 2003. The letter states that the PPI amount would be paid as a Protected Monthly Payment of £282.93 which included the PPI payment of £5.94 a week. They also included a Life and Disability Policy Administered by London General Holdings Limited.

I have the Loan Agreement Number and the PPI Policy number.

I did try to make a claim on the policy in May 2005 but was unsuccessful as LGH stated that my illness was not covered by the policy!

The MBNA claim is sorted thank you.

I have sent the original First National Motor Finance PPI claim to Santander as I was under the impression that they had taken over First National Mortor Finance.

Hi PeckySue,

having read your thread,

 

and realising that I had an agreement with First National Motor PLC,

 

I initially contacted GE money who told me that Santander had since bought out the company.

 

Having spoke to nice chap called Clinton @ Santander customer services on 08712004150,

 

I didnt have the agreement number ...

.only the dates of the agreement ( from my £2 Statutory credit report),

which he cross referenced (along with my name),

and found an agreement number,

which he then converted to a Santander agreement number,

 

then 5 mins on hold whilst he spoke to the PPI dept.......

 

....Voila ! No PPI on my agreement (allegedly).

Santander have told me today that I don't exist on their records even though I have the account number and PPI reference number!:shock:

 

I'm now considering letting a PPI company deal with it as I don't know where to go from here!

Sue, well mine started march 03 & ended April 08, (5yr loan), and mine could be found !! Maybe suggest a call to the financial Ombudsman, coz I'm with Dx here, all you would be telling a 3rd party ppi company, is all the info you've got already!! Go it alone Hun, and reap the rewards yourself.

the life etc was mis-sold too,

they might have more docs inc a policy?

Yes outline what has happened so far, and maybe include your agreement number( maybe even a scan of the document ), which is irrefutable . They may even pursue your case......don't ask... Don't get !!!
