I have received a letter from Bryan Carter Solicitors stating that i must pay an outstanding balance of £99.22 to TMobile

and that this "must be paid within the next 14 days or else further costs will be added to my debt

if it is necessary to go to court and therefore the outstanding debt will increase."

 

That if I fail to act and they obtain judgment it may prevent me from gaining credit in the future

and will remain on the Register of Judgment Debts for a period of 6 years (which I am assuming is like a CCJ).

 

My issue is that I do not owe TMobile £99.22 but in fact £44.40 which I have already spoken to them about

and have agreed to clear this as the account was closed and that balance was for the last bill for November 2011.

 

What do I do? I have not contacted Bryan Carter via phone or in writing?

I guess in the circumstances you could simply write to BC along the lines of the following.

 

 

 

Dear Mr Carter

 

References.

 

I am in receipt of your rather threatening letter dated DATE

 

I suggest you speak to your Client, TMobile.

 

I would advise that I have indeed spoken to them and your claim is incorrect.

 

This situation has now been resolved with TMobile direct and I would now request that you close your file.

 

Yours etc..

I would advise you send the letter above by either Special or recorded delivery and keep the receipt and check in a few days time that it has been received.

 

I would then check my credit files to ensure that no adverse entries have been made by either TMobile or BC.

Make sure you have T-Mobile's agreement of the lesser amount in writing. Get everything in writing. If the £44 is the balance on your last bill then keep the bill safe, it is important.

These solicitors may be acting as debt collectors, in which case they will need a license and have to follow a code of practice. There is a lot on the web about how to deal with debt collectors.
