Catalogue of errors?

Hi Everyone! This is my first post but i have been perusing since my own bailiff visit 2 weeks ago.

 

The short version:

2 weeks ago they came knocking,

I paid the council directly the next day,

the bailiff wasnt happy...

..I then called rossendales to see what was left on the accound and there was £15 to pay..

...so i waited until i received their letter dated 14th August.

...and it said please make payment with the next sevendays so wecan close our file...

...so this gives me until tomorrow to pay?

 

Well they came again today and i gave them £105 just to get rid,

i was panicking and very distressed and i have twin babies and a 4 year old crying :/

 

So the amount was for £15 pound and then the £24 levy fee and £60 pound van fee.

...he levied my partners car,

the bbq in the garden and the table and chairs.

..i didnt let him in.

 

They said they needed proof that the car wasnt mine,

and i have since read that this is not my obligation at all...

.Im pretty sure that they cannot levy on fees?

 

The council said i had paid them in full.

 

Im thinking of writing to the government ombudsmen....

.I receive council tax benefit and housing benefit as my partner has a low wage and i am self emplyed not earning a lot..

 

Will this go in my favour.

 

What should I do?

Any advice greatly recieved

...Apologies i have a rubbish keyboard and Twins hence the quickness of this post so i hope it makes sense.

 

Im going to call the council tom and get a receipt for my payment..

.surely if its paid in full they have to include the fees?

 

Surely also the bailiffs should have tried to get this £15 under a separate order?

can you list what fees you have been charged

they should be something like

£24.50 first visit fee

£18.00 second visit fee

£24 levy fee may be able to challenge that

 

van fee £60 so was it a transit van?? they would need a tow truck to remove car that could be challenged??

 

contact your local MP

 

 

if the liability order was paid to council the bailiffs had nothing to act apon

Ask the council what is owing as you have been ripped off by the bailiff.

Ok im going to ask them tomorrow to send me a breakdown of fees.

 

last time they were here on the same liability order..

....They had on there owed £830

:O the council tax was £640..

.so i called and paid the coucil that amount.

 

..Then called Rossendales to see how they were coming up with the other figure with there fees..

...funnily enough they guy on the phone said i only owed £15.85 as I had already paid them £25 when i first received their letter.

 

when i got the letter,

it was given to me by my postman and it was addressed to my old address round the corner,

 

i called them and told them my new address (ive been here 8 months)

thats when i got my visit!

 

I did a bit of research and thought that the bailiff had to go back to te council with my new address

and they had to send a new LO out?

 

they didnt, they just turned up!

 

This is what is on the letter:

 

client debt and costs outstanding : £15.85

first visit fee: BLANK

second visit fee : BLANK

Levy fee :£24.50

walking posession: BLANK

other: Van £65

 

Inventory:

 

reg number and Blue renault scenic.......Its Silver!!!

Also te table and chairs are on there.

 

I was a shaking mess today,

they are so aggressive...

he was in my garden and i asked him to leave and he wouldnt,

i said he as to if i ask him politely and he said he doesnt have to do anything.

I really will see this through to the end.

They cannot be allowed to get away with it!

Also when I called them today...regarding the

 

"Please forward this amount within the next 7 days to unable us to close our files"

 

Dated 14th August...

 

When i challenged the lady on the phone, she went away for ages, for her to come back and say...Ok the letter says exactly what you have said, but it doesnt mean that it stops us recovering money owed.

 

Ummmmmmm???Surely I should have had 7 days? Fancy levying a car for 15 pounds worth of fees!

Was the levy fee & van fee charged at the same time?

With Council Tax the Bailiff is allowed to deduct his fees first, you also say you still owed £15-85 so therefore monies were still outstanding and he is allowed to continue enforcement.

Yes they were charged at the same time.

 

I have spoken to my MP's secretary this morning and also the council...who are starting the formal complaint procedure for me.

 

The problem as I see it, it's not the £15 but the misinterpretation of the letter stating that I have 7 days to get the payment to them, and they clearly have not done this.

They have levied my partners car when I told them it wasnt mine

and the fees that have been charged.

 

The council have said in their eyes the liability order has been closed and they would have paid the bailiff their fees as I had paid directly.

 

We shall see!

 

I have calmed down a lot today but still feel jittery, it's not good.

Do you have this in writing, and what did you pay the bailiff when they visited after you paid directly?

You say this is for an old address. Did you live with your partner there?

You are right this is a catalogue of errors.

 

1 the warrant is for a different address and should have been returned to the Council for amendment.

2 they cannot levy on the car and charge for a van fee on the same day

3 if your partner was not included on the council tax form at your previous address, they cannot levy on their car.

4 not giving you 7 days to arrange payment.

5 trespassing on your new property -they should have left straight away as the warrant is for a different address

6 the levy would have been illegal because of wrong address

 

I would have thought that the L/O is very much not closed. Rundles have some explaining to do.
