Nram Ignoring SAR, No response since end of March!

Sar'd Norhtern Rock as have loan and mortgage with them, sent the letter template from here with the wording "if you require a fee blah blah" becasue I had so many to SAR I didn't want to put cheques in them all as I know from previous experience (reclaiming bank charges) some creditors waiver the fee.

 

I have had no response by letter but they do keep ringing my mobile (which i don't answer as I don't want to say ANYTHING on phone)

 

Wrote again 13th June and gave them 14days before I reported them and told them to communicate only by letter but still no repsonse so sent a copy of original SAR on 14th July but this time I enclosed the £10 fee. I have told them on this one that after 40 days I will, without warning take court action to force compliance and as I have now enclosed the fee which I assume is the only reason you have failed to action my request, I expect my request to be actioned without further delay.

 

Lesson to oneself - Always send a £10 fee in the first place it's a lot quicker! (and saves on stamps sending chasing letters recorded delivery at £1.55 a time!)

Yes, you should have enclosed the fee when you sent the first request. All banks appear to be stalling with regards to SARs.. you just played right into their hands.

 

They have 40 calendar days to comply - have you checked on RM website that they have received it ?

yes they received it yesterday. By them stalling only makes me more and more convinced they are hiding something, I sar'd paragon, no fee enclosed and had everything within a week! and guess what.... NO PPI paid lol!

I've done a spreadsheet now as I have SAR'd 11 in total so far, now it's easier for me to see deadlines and progress etc, everyone else have received cheques etc natwest, Paragon and MBNA (Natwest and MBNA said they'd waiver fee and admitted how much PPI I paid but I'm just waiting for statements now)

 

fingers crossed that Northern Rock don't force me to force them :-)

A good plan to use a spread sheet for keeping track of so many SAR's. Wish I had thought of it :lol:

Here's un update but first I need to scream Grrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr!

 

That's better. Ok so I re-sent "offical" sar on 14th July as mentioned above. I received a letter yesterday thanking me for my letter dated 13th June where they confirmed that they have received my SAR and fee (that was the letter complaining that they ignored my Sar of the 30th March - no fee enclosed in this one that was sent later!) and they also enclosed my £10 cheque (hang on, as I just said this was sent in the letter dated 14th July!). They styated the reason for writing to me and returning my cheque was becasue I didn't sign my SAR!!!!

 

Ummm ok well I DEFINATELY signed the first one because it's a joint mortgate so we both signed. secondly the cheque they returned from my "official" SAR dated 14th July had a perfectly clear signature on it anyway. (I'm hardly going to sign a cheque to NRAM on behalf of a fraudster trying to obtain my data am I!)

 

Another stalling tactic! I'm fuming. Another cost for recorded delivery too. Can someone please help me write a very stern letter to them because they only have until 23rd August to comply. Really I'm being generous here because technically I first wrote in march whcih they comltely ignored. Only becasue stupid me didn't enclose the fee I did it all "officially" in July.

 

I am so mad! They should not be allowed to get away with this just to stall. grrrrr!

TBH, you will be wasting your time. They are entitled to have a signature on the SAR as proof of identity. Without question they are being unreasonable and there was no need for them to send your fee back.

 

What I would be saying is something along the lines of..

 

Please find enclosed, yet again, signatures and fee for Subject Access Request originally dated XXXX. Since that time, you have used petty reasons to stall and restart the compliance date.

 

SAR dated XXX did not enclose the fee, an error on my part and easily remedied. Which it was in the form of a new SAR.

 

According to the Information Commissioner, there was in fact no requirement for me to make a NEW request - simply that the fee needed to be sent to you.

 

However, I did make a new request dated XXX , including the fee, but this time leaving off signatures. As we have been in contact over this matter then there was no further requirement for you to establish my identity !

 

I must insist that you now comply with my SAR dated (the 2nd SAR Date I think) the fee is returned to you - signatures are appended and I now insist you comply with your obligations and provide to me, ALL financial data by (Work out the compliance time from the 2nd SAR date - plus say 7 days for the phaffing around) further delays will be reported to the Information Commissioner and a formal complaint made to Santander.

DONT FORGET TO SIGN ! and enclose the fee.. again !!
