Can I ask a quick question?

I took out a loan in 2003 and for one reason or another I stopped paying sometime in 2004. The last time my credit file was updated by the lender was July 2006. No-one has ever chased me for any money and I have had no contact with the lender since 2004 yet my credit file says the loan is still active with red 6's everywhere.

 

Simply put how do I get this removed from my credit file?

Has the debt been defaulted, look for the ''default'' date on the credit file.

 

The debt is statute barred it would seem.

Who was the lender? (Welcome by any chance)?

You will have to write to the lender declaring that

the debt is statute barred and you will not be paying.

First let's know who the lender is.

Unfortunately there is no default! It is still active!

The lender is a company called London Scottish who I think are in Administration. I do wonder whether there are different rules which apply to a company in administration!

 

I guess they should have defaulted it back in 2004.

I spoke to Experian and they said that the account will remain on my file indefinitely!

Very good chance that the entry can be removed as unfair,

using late payment markers instead of defaults is a no, no.

The last time they updated it was July 2006!

Not entirely sure how to go about this, would be grateful for some guidance as I don't particularly want E&Y or some other mob hassling me, even if the debt is SB.

Hi Bobby,

We can tackle this on, you will need to do a little research on who is the actual owner of the debt now,

when you have that info send this to their DATA CONTROLLER.

 

Formal Complaint.

 

Dear Sir or Madam,

 

I refer to entries made on my credit refereence files made by London Scottish.

I do not acknowledge any debt to LS or any other party.

 

I enclose a screen print of the entries for clarity, as you can seen there is a series

of ''late payment'' markers placed on the entry, when in fact the alleged debt should

have been defaulted on xxxx xx.

Therefore these entries are unfair as they cannot be removed after the normal six year

life of a defaulted entry.

 

The Information Commissioners Office Technical Gudance on Default Entrries states thay

''Late Payment Markers Should NOT be used instead of a DEFAULT entry.''

 

I therefore require you to remove this entry from ALL credit reference agency files immediately,

should you not comply I Will make formal complaints to the appropriate regulatory bodies and

WILL seek compensation for the uneccessay damage done to my credit status.

 

I expect you to confirm your compliance in writting within 7 working days.

Put in all the details you have.

 

Send Recorded Delivery.

 

 

 

I must also point out that the alleged debt is STATUTE BARRED and I will not now or in

the future make any payment or offer of payment.

In deed so, the use of late payment markers after more than six months an not

placing a default is now an excellent opening for removing entries as unfair.

 

I have been working on a series of Welcome/ Cattles accounts that are in the

situation so far ALL entries challenged have been removed.
