Hi all

i am hoping someone can advise me i took out a couple of

payday loans and could not afford to repay i did contact the

companies to set up repayment plans but i am having no luck

and i am starting to get worried. Wageday Advance are asking

for a expenditue form and bank statement but i use my parents

account i closed my own account. 24/7 Moneybox are sending

me letters and emails and are demanding £104 a month and

have said they won't accept any less. I am getting demands

from Motomile Finance i have ask for a repayment plan but

seem to be ignoring this request and keep sending emails

for full payment. I have also had threatening emails from

N.D.R/Marshall Hoare bailiffs demanding £600 and they

are coming to visit my home to seize goods to the value

of 9x what i owe,i don't want this as i live with my elderly

parents. Any advice would be greatly accepted

ignore the NDR threats. Theyre doing the same to almost everyone because theyre about to lose their license.

 

Dont stress over what the PDL's say. YOU are in charge of repayments. Not them.

 

I'm about to head to bed right now, but if nobody has posted by the time i get up, ill write up what you can do.

 

Just dont worry for now. They cant do ANYTHING remotely like what they say. Go get a good nights sleep.

Hello again.

 

Time to ease your worries.

 

Take an hour or two and sit down. Have a cuppa, and work out ALL your incomings and outgoings. This is the most basic, but most important step that you must take in order to get away from Pay day lenders.

 

If you aren't sure what to include in the incomings and outgoings, head on over to http://www.nationaldebtline.co.uk/england_wales/debt_advice.php#5 and download the Personal Budget Sheet. Once you have worked all that out ( remember to take a good amount of time, so you get it right), download the Budget Summary and Fill it in.

 

You can then work out repayments to each of your creditors based on your financial circumstances. Send each Payday lender a copy of the budget summary, and they cannot refuse to take it into account. Be aware however, that some Pay day lenders will try and say you can pay more. Simply tell them NO. They get whatever is listed on the summary. If they do not like it, then they will only get £1 a month until they agree to your proposal.

 

Don't worry if they start to threaten you with Debt collectors etc, as they are the ones in the wrong. If you tell them you are in financial difficulty and prove it by way of a budget summary, they MUST take it into account and come to an agreement. If they don't, then they will be breaking OFT regulation on debt collection, and risk losing their operating licence.

 

Ignore Everything they say about their repayment plans. Repayments are to be made by YOUR terms, and not leave you in more financial difficulty. They cannot demand that you pay a certain amount. This again, is a breach of regulation.

 

 

Now. As for NDR/Marshall Hoares, they are currently under investigation by the regulators for harassment/intimidation. Ignore everything they say, never speak to them on the phone, and file a full and formal complaint with the OFT (Office of Fair Trading). They are breaking regulation all over the place, and also misrepresenting themselves as bailiffs ( which they cannot do by law). Never EVER agree to ANYTHING they say, as 100% of the time they are lying simply to extort money out of you.

 

You are in for a rough time getting away from these companies, but follow our advice, don't worry, and we can help you through this.

Thats why CAGs stance is any time a creditor breaches the guidance, they MUST be reported.

If you only have £30 then split it between your creditors. Tell them how much they are getting and send them a copy of the budget summary. If they refuse to agree, then file a complaint with the oft and create a formal complaint with the PDL.

 

Once you file the complaint with the pdl they have 8 weeks to respond with a final response.

After that you can contact the fos.

 

While all this is happening, make sure you send a letter or email a week restating your payment plan. Also send a token payment of £1 a week/month to show your willingnes to pay. Use standing order or postal order. Never give them your bank details.

Hi

I am slightly confused but i think i am making progress with 24/7 moneybox

firstly they said they will not accept £10 a month but they have provided me

with their banking details to pay £10 as a first payment

If you have their details. Just pay £10 every month till its repaid. Ignore their conditions.

Ignore it. You have their bank details, so set up a standing order of £10 a month and tell them thats what they get. Under Oft guidance on debt collection, they cannot force you to pay more, or force you into further financial difficulty.

Hi

I am now having problems with motomile debt collection agency they sent

me a email asking me to make a realistic monthly payment that i can afford

so i offered £10 they said it was to low so i offered £20 which i can afford at

a push as i have took extra hours at work but they again said it was to low.

So what do i offer

Its not up to them to decide. Work out what you can realistically pay. If its only £1 a month, then so be it.
