Hi guys, rightly or wrongly I have a parking ticket and would just like some advice. My wife stopped and parked in ataxi rank, a clearly sign posted taxi rank and we're in breach of contraventioncode 45. The vehicle registration is correct, the Colour is correct, the tax disc is correct, the car make is incorrect. The observation time is the same as the issuing time, but I assume that won't matter because we were in a zone that is no stopping at any time. The situation was, my wife has literally just given birth, she was driving home with the baby and starting feeling dizzy and felt like she was bleeding, which it turns out she was. So she pulled over and stopped and rung me to come and get her. Whilst she was waiting, she got ticketed. There were two cars in the taxi rank as well which were not taxis. A Renault Clio (the ticket marks us as aRenault, when we are a Peugeot) and a Toyota Yaris. The person issuing wasn’t in full attire either. Trouser and a shirt. No high-vis jacket etc. Can we contest this? Will the safety issue of driving have any baring?? Can we use the incorrect information as something to argue this? Also – I don’t know if it matters, but the traffic warden didn’t take any photos. He just ticketed and walked off.

If it would have been unsafe to continue because your wife was feeling unwell, then clearly she had to stop where safe. Since a taxi rank is better than in the flow of traffic, it sounds like a reasonable decision to me, especially if there was no parking space apparent. I think you have a good basis for an appeal on this alone, and if there are procedural issues as well then all the better (you could anonymise and upload your ticket for the experts to review). Congratulations on the new arrival and I hope common sense prevails.

I take it then that the parking bay just before the taxi rank was full then? Did she not try and explain to the warden what the problem was? Also, as she had literally just given birth, why was she driving? Sorry for the frank questions but this is what will be on the minds of whoever looks at an appeal. Presumably, you would be able to back up the situation with medical evidence as no doubt your wife would of needed some medical help... you may need to send a copy in with your appeal.

yes, the parking by the takeaways were full and short of stopping in the road, it was the only place, safe place, to stop.No, the wife gave birth 15th June, this was 28th June. However, my wife has suffered from a blood clot disorder and had to take a blood-thinner during the entire pregnancy, so she lost alot of blood during labour, she did have to have stitches as well – PLUS, she still has to inject the blood thinner, so her “loss of blood” still continues. Sounds dramatic I know, but she’s not bleeding all over the place, but she is bleeding still (slightly) and it's documented in her medical records. I’m concerned by my lack of “proof” and the fact I cannot contest we stopped in a taxi rank. But it genuinely was the safest place to stop until I got there. She did explain it to the traffic warden, but his response was “you still can't park there”. So what was the point in that :-(

If the road is still marked the same (google is from 2009) the yellow lines mark the edge of the carriageway so technically you are on the footway not in a bay, a 'no stopping ' taxi rank should have a thick yellow line along the kerb like a bus stop, the bay should be dashed yellow lines not double yellows.
