Hi everyone

 

Well the RBS offered me charges back plus court costs but not the interest and they asked me not to speak to a third party.

 

I declined on principle and to ensure everyone is aware if I'm successful that they can be.

 

They have now lodged with the court that they are defending all the claim.

 

So it goes to court on Tuesday. I need to file a minute today before 4pm.

 

So basically they're going to court for £20.11 min as that's the interest! They agreed to pay back £180.00 but not the interest. Are they mad ?

 

Well my defence will be that they have offered to pay back the charges but not the interest so I'm hoping the court will agree with me that they're being silly.

 

If anyone can help me though I'd be grateful for support. It may not get to court as they may pay up before Tuesday (is that the usual scenario). I've had a look through the notices but can't find anyone that says the RBS have paid up at the last minute.

 

If someone who is good at legal stuff and who wants to support me is in the Edinburgh area on Tuesday I'd appreciate someone to come along with me. I need advice on what to say should it actually get to court.

 

Very much appreciated if someone can help.

Bloomin' eck....that's nuts!!!:eek: I'm sure you'll NOT be going to Court;) ........I'll fall off me chair if you do, infact the whole of CAG will fall off their chairs and we'll all have very sore bottoms indeed! lol

I'll give you even money odds you'll either receive a cheque or offer before tuesday or that they will "forget" to turn up. They are just trying to scare / bully you.

Claim No.4:- claiming £1507.00, Court Papers submitted 5/4 !

They don't have a leg to stand on in court!! I am from the Edinburgh area and am watching with interest, I would be the same if mine goes to court!!! But filled with all the information from this site, I would be definately willing to take my chances in court and see how much they will get laughed at!!

I won ! They basically settled the day before however it went to court and the person from the bank spoke on my behalf saying they'd agreed to settle. They were given two weeks to pay which they did and the case is now closed.

 

Won so far

 

RBS - paid in full with interest

Capital One - paid in full with interest

Halifax - paid in full with interest

MBNA - paid in full with before going to court

 

Waiting for

Monument - taking to court - filed forms this morning

Lloyds TSB - taking to court - filed forms this morning

Egg - they offered part back - I declined - going to court - they have until Tue lunch time to pay up full amount or papers will be filed tomorrow.

PLEASE don't forget:

 

The interest under Civil Procedure Rules of 8% is NOT an entitlement - it's a privilege which MAY be awarded at the discretion of the Court!

 

The court could in theory take a fairly dim view of a litigant who holds out for the interest having been offered a full settlement. They very rarely do; however it's a possibility.

I dealt with their solicitor in the end and I emailed her to say that "my brother-in-law is an ex bank manager and was somewhat surprised that the RBS were willing to go to court for £20.11. I was writing to her on his advice to see if the matter could be resolved before getting to court and it was only on his advice that I was doing so". I also said that I have a friend who writes for a paper and he would only be too happy to take a story but it wasn't my intention to do so. I also told them thought that I would not sign any agreement saying I would stay quiet. They settled !

 

Someone told me that their main concern seems to be that we go to the papers. If you promise not to or threaten that you will they seem to pay up. This is just what I was told and it is what I did and it worked - it may work for you. But the main thing is don't panic - they are getting to court for most of their cases but they seem to be paying up.

Good point! Papers threat will be next. Only emailed LBA on Friday and paper copy going today to Tommy Mclean.
