      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

They're also interchanging the 16 digit Credit Card Number and ALSO call it an ACCOUNT number...shall I just input the first 8 digits ONLY...should not really make a difference to the efficacy of the spreadsheet would it?

As a reminder I know this thread is titled HBOS PPI CLAIM and that is what I shall be doing shortly with SAR and inputs on this thread...I am only for now trying to get to grips with spreadsheet in order to calculate a MBNA credit Card PPI that needs to compare with an offer ALREADY made as my friend is not satisfied UNTIL WE independently verify it...

 

He dont trust their payments without investigating a little...dont blame him:madgrin:

i would suspect you need to also change the region for office.

 

start/programs/microsoft office DDDD/microsof0t office tools/ language tool

Ok

 

In the amount of charge column you are entering, for example, £2.80 with the pound sign.....just enter the figures 2.80

 

Change the format of the account number cell to "number" with no decimal places OR prefix the 16 digit account number with an apostrophe ( ' )

Oh another thing....the claim is FROM October 2003 as that is WHEN their letter in correspondence states that PPI Account was added to Credit Agreement...however Monthly statements in SAR ONLY start FROM 5th July 2005....

 

What do I do and what spreadsheet do I use...

dx...I did not understand about the office..please expand

 

you need to change the language in office as well as your operating system. [windows]

 

when office was installed

it would have installed the language setting that windows was set too.

 

thus now you've changed region in windows

you need to do th same for office.

 

follow the - start/all programs/etc etc route i sent.

please don't hit Quote...just type we know what we said earlier..

thank you for all your help today and last night

 

The spreadsheet is beginning to work completely in all areas...I am using FosC1 from 05/07/2005 until 03/06/2010 to see what the figure is compared to what they actually offered...

 

And then go back to it all again afresh and input an average of 2.00/month form 6th Oct 2003 Until 03/06/2010 to INCLUDE the missing months

and have a look at what the new figures would look GUESTIMATE like.

 

Settlement Date was paid by cheqiues just the other day actually 31st May 2012...so would sheet statint run from 03/06/2010 until 31/05/2012

Good Morning ....

 

I am sorry I cannot scan/not working...pls bear with me

 

ok...as the title of thread states...I have 3 ppi's to sort out...

2 Halifax Credit Cards and 1 unsecured loan...

 

But first a few preliminaries...

 

I shall deal with the Visa Cards first...The FIRST I want to deal with was signed in 2001

 

This particular form that came in the SAR s split into 2 halves....at the top it says 'Visa Card Application'....Underneath that it says 'Credit Agreement Regulated By The Consumer Credit Act 1974...

 

Then the form is split into 2 halves with 6 points...on the left hand column from 1-5...name address,employment...and in point 5 it says 'Product Details'...'If you would like the to take advantage of these services please mark the relevant boxes,,,then there is a tick which definitely looks like it has been made by a computer as the x is made by a computer...in the CREDIT CARD REPAYMENT INSURANCE box...

 

Now I know for a fact that the person I am doing this for is ONLY JUST doing a computer course NOW and he was approx...55yrs then

 

In the other half of the page at point 6(In the right hand column) it states Principal Cardholders Application and Declaration and then in between this and the Right To Cancel Box and Signature Box which clearly states 'This is a Credit Agreement Regulated By the Consumer Credit Act 1974 sign it only if you want to be legally bound by its terms.....there is stuff like credit scoring and fraud prevention etc...

 

However just above the title in 6. 'Prinicpal Cardholders application and declaration'...it states.....'Attached to this application form [/b]you will find important information about your account.Some of this is repeated in the Halifax Credit Card Conditions.You will find a copy in your Halifax Credit Card application Pack.

 

Nothing else came in the SAR apart form statements....

 

The Issues

1.As this was signed in 2001...is this Regulated by Agreements Regs 83/1553

 

2.Does the fact that there are no PT's at all..i.e APR,Amount of Credit or any of the matters contained in Schedule 6 1983/1553.. on this form affect the validity of PPI itself.... ab initio

 

3.Are the PT's 'within the 4 corners of the signed form? ....were the PT's present at point of signature?

Also...the Consumer Credit (Agreements)(Amendments)Regulations 1984...states that....a statement of protection and remedies should be in the content of the principal agreement...if NOT then it should be in the subsidiary agreement..'contract of insurance',,,however it is in neither in my form...whats the position on this?

For an answer to Post #71 I think the actual document would need to be seen but it is dangerous to rely on paperwork errors to try and go down the un-enforceable route.

 

For post# 72 they will suggest that a policy document and paperwork was sent out under separate cover. Whether it was or not is another matter.

 

You may be in danger of over-complication these PPI claims

Thanks ims as always...I will avoid using these arguments and just send them in a schedule of claim...for Visa card number1...

 

Another thing ...what does this mean....tyoday i received a letter from Halifax After ONLY having sent in SAR....They have said that there is a 'window of 14 days after which the file will be closed'

 

I have not even sent in a request for refunds yet...that Would have been my next letter...

 

What is going on?:???:
