Hi all info needed,

i have been paying lewis group £3 a month for a vanquis credit card debt

and completely forgot to pay it and

then got a phone call just saying because i have defaulted they can't accept payment

and because we are waiting for a claim for me to look after a family member for carers allowance

i don't work which means no income,

 

my mum pays the debt but between us we have forgot to pay it

 

i said to the cheeky cow on the phone if they are not happy to take me to court was that right

or not or what do you suggest i should do

 

i've paid it regularly till may's payment and its completely been forgotten

Personally I would drop it to £1 per month given your circumstances. Even in the unlikely event it did go to court a Judge would only order you to make payments commensurate with your income.

 

How old is the a/c, have they added any unfair charges & was there any PPI?

its about 4 years since i had the vanquis card

i think i was paying for something in advent of me becoming out of work etc,

but i worked for myself,

but i did cancel that after a couple of months of having it.

 

as i stopped working for myself i started looking after my dad but i don't get any money at all

 

so any debts i have my mum pays hence the £3

 

BUT WE TOTALLY forgot this month's payment, until they rang today

but they were really funny saying why don't i have income and if my mum is paying it for me

they wanted her income and expenditure to work out how much she can pay for me

 

i said i wasn't going to give them that and she said well we won't accept any offer from me because i have no income

 

in the end i shouted take me to court then and hung up because i was so annoyed in her attitude and end of the day its £3

 

Do you think i should send them the cca letter or the one where i ask them to write it off?

This is a total breach of OFT guidelines, a third party cannot be held liable for someone else's debts nor can they demand their income details.

 

Given your circumstances i would send the letter asking for the debt to be written off, also remind them that they are in breach of OFT guidelines & you are minded to make a complaint to the relevant authorities. ;)

thanks cerberusalert i am now in the process of writing the letter to ask them to write the debt off nd i will meantion that what they asked for mum;s income etc is a breach of oft guidelines and if they don't want me to start a complaint then they should write the debt of its small fish of what some people will owe its only 1500.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
