Hi,

 

My partner and I, are up to our necks in debt

 

things have finally come to a head and we have decided we cannot go on as we are.

 

We seem to be eligible for a Debt Relief Order

I rang CCCS this morning and told them I had done their debt remedy and a DRO was the outcome

the advisor is sending out information in the post.

 

This is our problem,

my partner and I have a combined debt of £9000 split pretty evenly of about £4600 & £4400 each.

 

The advisor told me we can not apply for a dro together it has to be seperate,

my partner works full time and I am a house wife due to long term illness and suffering with depression which I see my doctor about regularly.

 

I have no income we both live off his.

 

I am not entitled to benefits as although british I lived abroad for 7 years and I have not worked since we got back in 2010

so didn`t have enough contributions to claim and my partner earned more than the allowance based benefits.

 

what I would like to know is, as the dro will be seperate will I still be eligible for a dro as I have no income of my own?

 

The debts I have when I got them they knew I was a housewife and that I was living off my partners income.

 

Also how the heck will we work out the I&E form as somethings are in one name and somethings joint??

 

I am absolutely worried sick about it all at the moment I also have many things to pay in the next few weeks

the lady I spoke to from CCCS told me to send a letter to all creditors and tell them I will be making token payments of £1

and send my I&E form is this a good move do you think??

 

We owe some payday companies and have requested their bank details but haven`t got them all yet so I don`t know how I can make the £1 payment to them.

 

I am sure we are not the first couple where one is working and one is not to apply for dro`s

but I cannot find information anywhere with somebody in a similar situation,

 

so any advice or peoples experiences of doing a dro would be most appreciated.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

my debts are,

Payday Loans £895 Split between 2 lenders

 

Catalogues £3007 Split between 2 catalogues

 

Overdraft £500

 

My partners

 

Payday Loans £1920 split between 6 payday lenders

 

Catalogues £1259 split between 4 catalogues

 

Credit card £600

 

Overdraft £760

 

This is roughly what we owe in total.

IMHO i dont think you need to go down any serious route.

 

the payday loans should be dealt with on an individual basis

 

i think you already have threads runnig on these?

really really silly idea to get a dro mainly for them.

 

the cata logue debt DEF a NO -NO.

 

typically cat debts are inflated by +50% with unlawful PENALTY fees [£12 letters/phone/debt management]

 

they are VERY low priority [£1PCM at best]

and no judge would ever make you pay more.

 

bet the OD is mostly charges too- no-one will evr go near a court if it is.

 

just leaves £600 on a credit card, bet there are charges & PPI?? there.

 

youneed to start a new thread for each debt in the correct forum

 

and get reclaiming!!

Thanks I appreciate the advice, although the debts might not seem alot to some people they are to me and my partner he earns less than £20,000 working full time neither of our credit ratings are great anyway so we are going to go for the DRO if they will accept us. I just can`t deal with the stress of it anymore, our financial situation isn`t going to improve anytime soon so it seems like our best option.

 

If anyone here has recently been through the process recently of a DRO I would appreciate any advice or feedback of their experience I am currently waiting to receive information from CCCS and then hopefully we can get the ball rolling.

Hi Benibaby,

 

These Companies cause you stress because they know that they are legally at the bottom of the collection pile after your important bills i.e. rent, council tax, utilities etc. that's why they shout the loudest!

 

After being accepted for a DRO by the CCCS, the Insolvency Practicioner from Plymouth will send everything to you by post including on the first page a barcode, this you can then take into a post office and pay the £90 fee.

Please also note that you do not have to pay the £90 all in one go, you have up to 6 months to pay this after the first payment is made, so you can pay in stages as and when your budget allows.

 

Even if any of these Companies do go near a court - the maximum you could be forced to pay in your situation is £1 per calender month.

 

Forget threats of doorstep collectors, they have no legal powers - tell them to get off of your property or call the police and they will remove them for you.

 

As DX said above - start a new thread for each debt - follow the advise on here and you will be fine.

 

Time to take control and you will see you will have had sleepless nights for nothing.

I feel abit better about things today I received my ref number from CCCS this morning and spoke to one of their debt relief order counsellors and he was brilliant, he answered all my questions and there were alot!!! He put my mind abit more at ease which means alot at the moment. They are sending all the paperwork out to me we did the I&E form and now I just have to get the paperwork ready my end and send off for my credit report. So hopefully within the next month or so it will all be completed he said they have a turnaround of about 20 days at the moment, but he said alot of it depends on how quickly I get the paperwork back to them. I will keep the thread updated with my progress, thanks again to the people who posted, for their help and support it was very much appreciated.

Hi Benibaby,

 

When you receive your paperwork through from the CCCS, send everything back including copies of you credit report, paperwork of all debts.

 

Then phone them and they will go all through with you to make sure that everything is correct and then submit your paperwork to the DRO office - please note this is the last time you can amend any debts!

 

You will receive a call from the official receivers office in Plymouth once again going through everything and they will send you full copies of everything - page 15 (2 copies will be enclosed) sign one copy and return in the pre-paid envelope.

 

Pay your £90 at the post office.

 

You will receive a letter confirming if you have or have not been accepted.

 

If you are accepted, you will have a unique DRO number (i.e. DRO1234567), if any creditors contact you for any money, quote that number to them including the DRO office address in Plymouth.

You can send copies of your DRO certificate - BUT COPIES ONLY, NOT THE ORIGINAL!

I am in the process of getting all the paperwork ready and my partner and I have sent off today for our credit reports. Thanks for explaining the way it works, it seems quite straight forward so fingers crossed we don`t have any problems. I will keep the thread updated on my progress, thanks again for the help.
