Hi, im several months in arrears on my mortgage and have had a suspended repossesion order. I have decided let the house go and move into rented accomodation, but i will only be able to move where i want to go in about 4 weeks may be longer. the desission i need to make is if I pay this months mortgage payment, if i can get away with it i need this money for deposit. I have not been told they are going to repossess yet but when this happens how long can i drag it out for? can anyone help with what a typical time fame could be for this please ? its been hard to find information on the internet for this. Many thanks in advance, im eargerly awaiting your reply.

Thanks

Shaun

The mortgage company will issue an eviction notice which typically will give you approx 14 days before you have to move out. However, you can apply to the court for a hearing in front of a judge to ask for time to move out. I take it you haven't got an eviction notice yet ?

Thanks for the quick reply ! much appreciated. no i havent receved any eviction notice yet and the mortgage company are still in the beleif that i will be paying at the moment. Do you know how long it takes them to obtain an eviction notice ? do they have to go back to the court for this?

Thanks

They will apply to the court for an eviction warrant, there is no hearing for this they just make the application. If you don't pay this month's installment they may write to you first telling you that they will be applying for a warrant - if you dont respond or make payment they will then go ahead will the application. I would imagine you may have around 10 - 14 days after you miss the payment before they apply for the warrant and that could take around a week, when the warrant is issued from your local court you should have around another 14 days.
