      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Started the process on the 4 September asking for my statements, but as a few others have said this seems to be taking some time to be answered even though my cheque was cashed VERY quickly... But the 40 days aren't up until 14 October!

 

What finally drove me to start the claim was being charged £25 to cash a cheque that put me £0.93 overdrawn, one day before my regular 4 weekly salary was paid into the account. Then the cheeky b****rs went and charged me £25 plus interest for being overdrawn!!

 

There is so much information on this site, but I'm sure that I'll have some questions, so thank you in advance for anyone that answers them...

Don't forget to open a parachute account as they will close your account once this is all over with. Not very nice of them but they have told me they will be closing it on 20th October or i can do it before then. Oh no!! They can do all the work on closing the account :-) I'm not doing it for them!

Another reason for doing this is that I have just finished an IVA and sent off my completion certificate to various credit agencies. The A&L have been extremely unhelpful during my IVA and I have been wanting to tell them what to do with their account for quite a while now.

 

Hoping to sort out a parachute account this weekend. Does anyone have any suggestions of a halfway decent bank that might take me on...???

Received my statements this morning and spent a good couple of hours this afternoon going through them. Now filled out the basic spread sheet (Thanks Vampiress :D)

 

Was quite shocked to see the total, including my Data Protection Act cheque, add up to £666.50... Hmmm that number seems familier...the beast and a half??? ;-)

 

Well the letter will be sent off by recorded post on Monday. Lets see how long it takes them to send me their standard bog off letter....

So the A&L bog off letter arrived this morning and I've taken the plunge and sent my

LBA back them by return post. :grin:

 

There seems to be mixed opinions on waiting the full 14 days, but I decided that as they had rejected my claim I would get my next letter in ASAP. Now I sit and wait for them to turn this letter down and get my MCOL ready to go. However this will probably have to wait the full 14 days, as that will tie in with my next salary payment..... or I could always make use of my overdraft facility to pay for it ;)

 

Reading the threads on this forum (especially the successes) has really kept me going and focused on getting my money back.

 

Oh yes, almost forgot to say, my parachute account was opened this morning with HSBC. The guy said there seemed to be a lot of people moving bank accounts just lately.....

I noticed that Nat West say in their ads that somebody opens an account with them every 12 seconds. I couldn't help but wonder how often they were CAG members.:p

 

By the way, everything looks fine but I would be inclined to wait the 14 days from your LBA before claiming so that you can show the court what a reasonable person you are giving them plenty of time to avoid court action.

Received my standard bog off reply to my LAB from A&L today.... boy they're getting quicker. Thats a day earlier than the reply to my prelim letter!!

 

So taking Caro's advice to show what a reasonable chap I am, I'll be waiting another 7 days before putting in my MCOL.

yes just wait now, the next step for me was an acknowledgement from the court and then a letter from them saying A&L intend to defend then payment not long after, hopefully this will go the same way for you...

Latest update is that I got home to night to find a court letter saying that A&L intend to defend my claim.

 

From what I have read on here, I think that means I should expect to receive my cheque before the end of the month. I think it's going to be a VERY good Christmas this year :lol::lol::lol:

Guess what was waiting for me when I go home today????

 

Yep a lovely cheque for just over £960 from A&L along with their usual letter saying that in this instance they are willing to refund the charges, but will be contacting me about the running of my account!

 

Doesn't really matter now as I have a new bank account (into which I have paid the cheque today). I just don't seem to be able to stop telling people about this site and the process. If I can help just one more person to claim back their charges.....

 

One thing though, when I went to withdraw the last of my money from A&L at lunchtime I was told by the nice lady that I had my account flagged up as a 'pre-approval for a low cost loan' She looked a little taken back when I said I wouldn't be taking up their offer as I was closing my account this week.

 

All I can say is thanks for the help and support, my donation will be made as soon as the cheque clears.

 

Anyone else thinking about doing this or currently in the process, just keep the faith, stick to your timetable and you will win!!!!
