Hi,

My partner has received a letter from Equita today regarding council tax due. I have been making payments on this account for him as I have recently moved out - its complicated!! I have not contacted equita yet as i have first contacted the council as it is for the current year. Should I be able to continue paying SODC as I have requested i make payment to them and they take the account back from Equita.

Please advise me

Hi there

 

If Equita are involved it mean that the council has obtained a Liability Order for the full outstnding debt - court costs will have been added as well. By all means ask that they take the debt back but it is unlikely they will do so at this stage.

 

Ensure that you an your partner understand your rights and the bailiff's powers - there are numerous threads on this forum already so we won't regurgitate everything. In a nutshell, don't let them in and if you own a car, hide it! What council is this? as some councils have outsourced their back office revenue functions to a firm called Capita, who also run the TV Licensing sales/enforcement team for the BBC. Surprise surprise they also own a couple of bailiff companies, Equita and Ross 'n Robbers, and where it is outsourced, to Capita you are not speaking to the council at all so they will parrot a script passing you to Equita, and so it goes on,. not insurmountable but it may be a factor in advice given,

It is South Oxfordshire council and the contact is capita, I have had it taken back before due to some fantastic help by a member on here. That was a few years ago though. My issue this time is that i have been making the payments to the coucil and they have still done this.
