Received a letter from Global Debt Recovery regarding an unauthorised overdraft I had with TSB 12 years ago, but they are chasing it on behalf of FV-1.

 

I initially did agree to make monthly payments as I was unemployed at the time, TSB then closed my account, and through moving house etc I forgot all about it.

 

I received a call from them the other day (dont know how they got my number) saying they wanted the debt paid, I couldn't remember the debt at first, I mentioned to the guy that surely this debt was too old to be chased and he said no it wasn't, they would send an invoice out in the post.

 

The debt is for £382.92 (dont even remember what the debt was back then, but I am certain it wasn't that amount).

 

Any advice would be great.

when was your last payment made on the account? It seems as if Global has purchased a lot of statute barred debts and are trying to fish for payment. Dont speak on the phone to them ever, they now know they have a person that can be chased as I suspect you have confirmed your name/address/DOB for their 'Security' questions. I would sit tight and see what they do next. Of course they are going to say it isnt statute barred they are hardly likely to say yes it is so you dont have to pay...... If you have made no payment or acknowledgement of debt in last 6 years its statute barred check your CRA file if it doesnt appear then its in all likelyhood SB so ignore them

I dont think I ever did, for some reason I went overdrawn, they closed the account, they asked for unathorised overdraft to be paid, I said I would pay it back, moved house and forgot all about it, that was 12 years ago.

Hi

 

If you are in Scotland (I asume you are as you posted in the Scotland Forum) then if no payment or written acknowledgement has been made in a clear 5 years then the debt is SB and extinguished.

 

SB is an ultimate defence.

 

Stay off the phone to these people.

 

I was amused that they are going to send you an invoice for something...that should be an interesting read.
