Hi

 

Hubby received a demand for £399.99 from Capquest saying they had bought the debt from Orange!

he did have a debt with orange - for £500 - but this has been cleared with Lowell Portfolio

 

I sent off a request to see the original contract along with the £1 fee but this morning a letter came back saying that the account was not a credit agreement but a service agreement (?) and therefore not covered by the CCA

 

They are making the usual nasty threats but on checking hubbys credit file they have put a charge on there - so now Im really cross and need to know what to do next - I want that charge off his file!:-x

 

Is there a template of another letter to send or is someone able to point me in the direction of what to do next?

you mean a charging order?

surely not?

they'ed have to of gotten a CCJ first.

VERY VERY rare for a mobile phone debt.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

have you a letter from lowlife that is was indeedd cleared?

 

sounds like he's been had as a cash cow

and the patyments lowlife went straight to their pocket

and not off the debt.

To try and ge the default removed you need first

to find out if this debt actually exists, as suggested

above, the route then would be to write to the Compliance Manager

at the DCA/Creditor that placed the default giving you reasons

for wanting it removed, copy the letter to the credit reference agency

as well.

You will probably find that the DCA will confirm that the default is

properly issued, you need very strong evidence to get it removed.
