      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi there,

 

We bought a Comet - PRT295FFCS fridge/freezer broken in January 2008 and we have had no end of problems with it. For the last 2 years water and ice has been regularly building up in the bottom of the fridge meaning that every few weeks we have to remove the ice build up and mop up the water.

 

We contacted Comet to complain about this and they didn't want to know.

 

We then got an independent fridge engineer to look at the fridge problem and who said it was a design fault in the fact that the water drainage tube runs down the back of the freezer and therefore freezes the water in the pipe, causing a backlog and over flow into the bottom of the fridge.

 

We wrote back to Comet who said that they disagreed with the independent engineer's report and that we would have to call out one of their engineers to assess the problem.

 

In the meantime the fridge has completely packed up. We noticed that the temperature just kept rising and when it got to 18 degrees we realised that it was broken.

 

After giving in to getting one of their engineers out at the cost of £69, they could only give a time of between 8am and 6pm. They couldn't be more precise than that which is ridiculous. The engineer finally turned up at 5.30pm last Friday to say that he didn't know what was wrong with the fridge and that he thought it was either the motor or compressor that had failed. He also said that he didn't have the right equipment on him to test the pressure of the gas in the fridge and so I would have to get another engineer out. Regarding the water/ice build up, he said it was our fault as we had obviously got food down the drainage hole at the back of the fridge. I disagreed and said that wasn't possible. Then he said that there was a manufacturing fault when they built them, something to do with some foam they put around the drainage pipe.

 

I called them on Monday to arrange another call out and they had just automatically assigned a random day in the week to come out. I said they shouldn't just send out an appointment without checking first and as per usual with Comet they didn't care and said well if you want another date you will lose this slot. The next date is 11th November!!! I was also advised that the engineer that came out should have been able to do the necessary tests - useless!

 

We are now in a position where the fridge isn't working, we have borrowed a small fridge off friends to tide us over and despite being turned off the bottom of the fridge is still filling up with water and ice!!

 

Please advise what our rights are as Comet just keep fobbing us off with the "you don't have extended warranty".

 

The fridge will be 4 years old in January 2012 which is nothing for a fridge-freezer.

 

This whole experience is totally frustrating and annoying and their customer service is a joke!

i have moved your thread to the comet forum

 

there are lots of threeads about your model

 

it is a known manu fault and should be replaced

 

have a read how others have gotten on

and what they did

 

you should also get the inspection fees/repair costs refunded too

 

you issue IS with comet under SOGA

 

sadly they are always very lacking in this dept

 

you DO NOT need the extra insurance!!

 

SOGA covers you for ALL

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
