Hi Everyone

 

New to this forum, but as there seems to be a severe lack of support in the community for people struggling to understand dept and the whoel Credit report world then I am hoping someone out there may be able to advise.

 

Problem is: I have Default notices on my credit report that are coming upto being on there for 6 months.

 

Defaults are from: :violin:

 

1, RBS Defaults: Defaulted: 05/11/05 balance £737, Date updated: 10/08/08 (but default date still remains the same) Satisfied: NO :x

 

No contact from them at all now, and has never been settled dept includes about £350 of charges, original dept only £450... :x

Personal reason: they hit me with a load of charges in the middle of a tough time in my life and one thing led to another and never paid it off or battled it in court as ended up being out of the country for a few years.. This one i seem to have information on file of it being passed to 3 different debt recovery agents all of which never seemed to file anything further but send nasty letters...

 

2, HSBC PLC: Defaulted 15/11/06, Balance: £123 Satisfied: YES 15/11/06

Have no idea what this is - Seriously cant remember but is still on my file its even settled. ONLY £123!! even the number seems strange!!:???:

 

3, Carphone Warehouse:: Defaulted: 29/03/06, Balance: £488, Date updated: 19/04/06, Satisfied: NO

I think this is a 3 mobile or Vodafone contract phone that didnt even work on London Bridge!! in the early days of 3 mobile!!.. i probably spent £488 on the phone arguing with the buggers and didnt get anywhere, In the end just forgot about it.. oops - not good i know.. but i was young and living the carefree life then.. I have no idea which mobile it was for or anything...

 

There are no CCJ's or anything like that just a load of nasty little Defaults, what i want to know is :whoo:

 

1, Do you think it best i pay them off.. or will this initiate another 6 years until they may come off my credit report??.

2, Shall I just wait and see if they drop off automatically - i.e. RBS one will go first??

3, I have tried getting in touch with them by letter but all of them have requested I go to a branch to sort it out as they are unable to find my details from what i have given in the letter.. (basically all info Equifax gave me).

4, Will they automatically dissapear even though they have not been paid off?? (I will pay them if it will help, but i have a feeling now it wont make any difference).. confusing!

5, Do I infact need to settle these debts before they will be wiped off my credit report?? even after the 6 years??

6, From what date does the 6 years start?? is it the default or the date updated??

 

 

Im really confused with all of this.. :-x Do i pay and start the clock rolling again?? do i not pay and just see if it drops off

 

So you all know, I did improve my life and am not creating any more debt for myself.. but am hoping to get on property ladders etc or even open a UK bankaccount more than a cash account, but this is hindering me even doing that.. all seems TOTALLY crazy :-x how a debt of around £1000 before charges can really hold some one back so much in this country, and there is very little advice out there to help us.

1.paying off debts will just extend their [the default within the account summary] showing for 6yrs

2.theyand the whole account] will go after 6yrs from YOUR last financial transaction

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Creditproblem,

 

If the Carphone Warehouse account had been billed by us directly then the default would be registered by us.

 

In regard to the defaults on your credit file these will naturally come off once the six year limitation period has been reached and as far as I'm aware this isn't extended in the event that you make any payment towards the debts showing.

This totally contradicts what I have been told on this site - I have been told that defaults go 6 years from the registered default date, not the last financial tranasction date. If so that means I now have a default registered for another 3 years instead of 18 months as I have made a payment after the default was posted on one of my accounts.

 

This is really annoying now as I am getting loads of contradicting information - does anyone actually know the correct answer. :???:

Defaults remain for six years from date shown as ''DEFAULTED ON'' in the credit file

they are removed 6 years later paid or not, the Statute Barred 6 years starts

from the date of the ''last delinquent payment'' ie missed payment and no further

payment made fo 6 clear years.

If you clear the debt completely the filed should be marked satisfied and the entry

is removed six years from the ORIGINAL DEFAULT DATE.

*You will extend the period by making part payments* only.

Thanks Brigadier - I have a payday loan at the moment which has a registered default of last June - I am currently making monthly payments on this with the view to settle it in 6 months time in total. If I continue this and it is settled will it remain on my file for 6 years from default date or will it then be 6 years from the date of last payment which will effectively settle the loan. If its from last payment date I might as well not bother paying anymore as I am just extending the date every time I do.

The default entry will fall off the file after

6 years paid or not, this statement should

be visible on your report printout.
