Case 1:

I've had a missold ppi case against Lookers and blue motor finance that I took on car finance back in 2006 rejected by the financial ombudsman. The case was started in 2008.

 

The only problem is that I knew exactly what happened when they were doing the car finance - the salesman put the ppi on without telling me or discussing it with me first - the 'do you want ppi?' box was ticked already by the salesman.

 

I am absolutely livid with the FOS about this and am considering court action against both the car finance company and the ombudsman (for their decision and taking over 3 years to sort out the case). I have called unison about this as I am a member and they have passed my details to a solicitor.

 

Case 2:

Also I put in a complaint to the ombudsman against Lloyds TSB for refusing to help me when was struggling with the loan payments - they rejected that as well and I am also considering re-opening this case as I'm finding that the FOS look to be quite a corrupt organisation?

 

Any help/advice would be greatly appreciated as I'm ready to go for legal action.

i too have been sold a ppi when buying a car from lookers / blue motor finance, i have had a letter back today from blue motor saying that it is not them that i need to complain to but lookers ? so i am copying my last letter that i wrote to blue motor and sending that to lookers today, i actually think that they are just trying to mess me about? i have my agreement from blue motor finance and from lookers but cannot find it anyway about the ppi, also we wouldnt have taken it out as we are self employed and have never taken ppi out in the past, i have paid this for the passed 6 years without even noticing, luckily i have it on my statement from blue motor that £50.55 is going out to them per month!

 

how are you getting on with yours?

Lookers said that to me as well - looks like they're just trying to pass the blame on.

 

What I'm doing is seeking legal advice and after that court action.

 

I'll be taking legal action against Lookers for misselling me the ppi for reasons listed in my first post. As well as the ombudsman for coming to a biased decision which has no relation to the facts at all. With all that I've read on the internet about the fos making wrong decisions to meet their bonuses the fos need to be careful. I am also putting in a complaint against the ombudsman for taking 3 years to come to a decision.

They got back to me today apologising for the 3.5 year delay - yeah right they aint sorry. The only person who's sorry is me for dealing with such idiots like the ombudsman.

 

Soemone please start a review on these incompetent fools so the public can see what they are really like.

i still am having trouble getting my pp:evil:i reference number, blue motor say its the same number as the account number on my blue motor loan, i have sent my questionnaire that lookers sent to me back to them with the blue motor reference number, lets see what happens now???????

just had a letter from lookers requesting a statement of all the ppi that have been paid and a letter to say that we have not ever made a claim from them? where am i supposed to get all this from? i have asked blue motor to send me a copy of my statements??????? the more they try and get me to back down the more i get anxious to sort it! :mad2:

Sounds very much like iffy tactics they're using - how come the Omberksman (my new name for them) can't see how this firm operates? :-x

 

Might be worth involving your mp as well as the more these corrupt companies are mentioned in parliament, the more likely the government might clamp down on them???

Received the documentation back from the ombudsman today. Now I know why the ombudsman ruled in their favour because Lookers have blatantly LIED to them!!! Lookers claimed that I had a chance to have no missold PPI with the car finance - BLATANT LIARS

 

I saw nothing on the agreement that could have allowed me to have no PPI. Anyone know a good specialist solicitor who can take these firms down for who and what they are - BLATANT LIARS. :-x

 

If I ever get hold of that salesman...

i have today received a letter from lookers asking me to accept some money, its a final settlement sum which is absolutely great as its what i have asked for with the interest on, so i will sign the letter which they have sent then await my cheque?? lets hope i get it for xmas, good luck to them all still trying , :-D

I'd complain again on this PPI

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

These "the rep ticked the box" things go no where (most of the time).

 

If you are making that very specific allegation - it has to be proved. It turns into a case of one persons word against another concerning a transaction which took place years ago. Difficult.

I signed a HP agreement for an MG ZR car 8 years ago as my old car had a number of faults with it.

 

 

We went through the agreement and I noticed after I got home that the agreement saying do I want ppi had been ticked

and this was not discussed with me.

 

 

Also at the time I was unaware at the time that ppi was purely optional

and naively thought that it was a requirement of all credit agreements.

 

I tried taking action against Lookers as I discovered they had missold the ppi and got the Ombudsman involved

- this was 2008-09.

 

 

The Ombudsman rejected my claim - presumably because I had no proof that the salesman had signed it

without discussing it with me and asking me beforehand - which is what actually happened.

 

Maybe its worth trying again with it but I don't think the Ombudsman would be the right people to involve as they'll prob just reject it again.

I know you used a reclaims company the first time

 

 

did you ever see al the statements

and the demand and needs sheet

and the agreement.

 

 

if the sheets were pre ticked [like say the PPI/life/asu etc offered by HFC thru Hamilton life ]

then lots of those old cases have been re-opened and settle.
