      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Been avoiding my finances for a longtime as I know its in a bad state. Some might say its not as bad as you can clear it all

in only a few months, theres the problem, I only have a few months income left before I relocate and have no income at all.

I'll list all my loans and hope someone can give me some insight

 

hsbc managed loan £900 £25 p/m its a very old loan 7years+

vanquish cc £500 £25 p/m minimum payment

capital one cc £500 £25 p/m minimum payment

Virgin-media £225 been i gnoring their letters, debt was 160, they stopped my service but is still charging me a monthly

fee for a service they stopped supplying, im no longer under contract with them

 

Capquest £180 £60 p/m payment plan 3 payment left

ukpayday £344 £172 p/m payment plan 2 payment left

quickquid £625 £312.50 p/m payment plan 2 payment left

 

wonga £1300 minimum due on the 10th is £300 to extend

lendingstream £400 loan 12/05/11 today i owe them £780, tried to set up a payment plan 10/05/11 and they was having none of it

a job I cant be in finacial hardship therefore cant set up a payment plan. As of 3weeks ago I started getting phone calls from Paydayexpress

hq, I have not answered any of those calls and now they called my job and all my collegues know a payday company is looking for me.

 

Barclays £700 no payments made to date, they have been trying to call me for 1 month now. Its my old current account with a £500 reserve, so thats the £500 reserve used and they add £22 a week in charges

 

I get paid the 10th of each month into a seperate account, never less than £1550 every other month £50 or so more and these are my expenses or rather the bare minimum I need

 

Rent all incl £345

Food £75

Travel £69

Phone £10

 

So I have £1050 a month to repay them all, I have 5 maybe 6months left of income. The payday loan intrest is killing me, I'm shaking

uncontrolably everytime i think about my finaces nevermind looking at them. I've been in the Uk for 12.5 years and I have nothing but

debt to my name, I'm returning to South Africa in dec or january for good.

 

I dont want the stress of debt chasing me if I just uped and go, I would really love to have a clean slate...a bank balance of £0 but then

I have nothing at the age of 35.

I was thinking if i repay my proper debt ie. banks and cc's and maybe make good on the existing payment plans which are all so close to be fully paid off

and ignore those payday companies I have not contacted yet then maybe ill have £2000 to start my life over.

 

But I'm scared at the way they add intrest, wonga,payday express and lendingstream today stand at £2650 and wonga alone's apr is well over 4000 %.

When i write this down and read it, it becomes real yet again, thats why ignoring it helps for my short term stress levels.

Please if you can offer any advice or insight it will be appreciated, please dont preach to me about the evils of payday loans at the time it couldnt be avoided.

Spent most of the night looking for a second income but as I'm already at work 15 hours a day including travel time the odd off day i get is really needed. And all those working from home jobs look like pyramid schemes so doubt I can up my income at all.

Just a quick update on payday express, I unbanned their telephone number today and answered their usual 1st attempt at calling me at 10am, had to sort this asap as its embarrassing that they called my place of work while i was away, and a work guy posted a huge note for me in the staff kitchen informing me AND 30 other people a payday company is after me.

 

Anyway, explained to her my situation and that I tried to remedy all of this 2 months ago, a quick income and outgoings list and she was happy to accept £50 a month for 3 months then a review.

But before she would hang up she said a gesture of goodwill would go a long-way, she wanted a July payment of £30, I said i have access to 4 pence in my current account.

She replied with, Can you do £25? I said no I don't have any money, payday is still 2 weeks away. She went down to £10. Setting up the payment plan was easy even pleasant up-to this point but luckily she backed down after the £10 request.
