      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

On another note, A&L have been more helpful, got through to a nice lady who directed me to a level 2 complaints person, who gave me the fraud dept number and said ask the police what to do first, they said it's a civil matter, ask the bank, so sitting thinking that's that, had the urge to call anyway and hey presto, I stuck to only claiming back the biggest payment, the one they took early, he asked if I had proof of due date , when I said yes,, he said ok will raise it as a chargeback, result, they had already said they would waive any charges anyway, but this means my account will not be O/D and I can close it.

 

So worth sticking at , just when you think it wont work and are ready to give up, remember , you don't know if you dont ask.

ksmiggy - as someone about to embark on the process of coming to terms with payday loan debt (and repaying it sustainably), and as someone who has taken out loans with several of the companies you have mentioned, I would just like to say that I find your thread and updates very inspiring and encouraging.

 

Please continue to let us know how you get on, I aim to do something similar once I work out the basic budget/pro-rata repayment options etc.

I was hoping it would help some people, although there are far wiser and more knowledgable people on here, most of what I say is just reitterating their words, maybe with a cheery twist sometimes, but nevertheless, their words still, I'll wish you luck for now and anything you need to know ask and someone will answer.

Hi Guys, I have just stumbled upon this forum/thread. I honestly thought I was the only person capable of getting into this muddle with these people (their websites are so inviting). Without a word of lie, I have barely eaten, or slept in as long as I can remember, foolishly telling myself the 'Ostrich approach' is working. It has been such a relief to find that there is a place like this that people can share their stories. Big thanks to ksmiggy for starting this thread; and of course to all those who have replied (your words have meant more to me than the initial loan that started this downword spiral) first thing tomorow i am going to make a list of all the priceless info in this thread. Thanks again :):):)

I'm not in a position to donate at the min , so I do what I can , if I can help someone I will, I believe in plain speaking ( tactfully if possible) and fairness all round.

I had hoped this thread would help others get the courage they needed to sort their mess out without cracking up in the process.

When I started all this I too was panicing and thinking allsorts of things could happen, i had a good search round the site and found the same as you did, many people in the same boat.

There are many helpful stories on here with a vast amount of information, I find something new nearly every time I come on here.

 

Thankyou for your kind words, it does make it all worth while knowing it is helping some people to overcome the fear of facing it all.(helps me feel I have paid CAG back a little too :) for all it's help )

Facing up to it is probably the hardest part, so if you make it this far, give yourself a big pat on the back knowing your halfway there, then take a deep breath and steadily work your way through them .
