      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi

we were approached by the fso regarding mis-sold ppi stating that we may have a claim against welcome with a claim form to complete , we completed it sent it off with 7 insurance and medicare 24 policies to them and then recieved a complaint form from welcome to compete ? very confused !!! however we completed that too.

we currently have direct payments from our wages to welcome for a defaulted loan,however today we have recieved a offer for 2 closed accounts from welcome !!giving us 10days to accept as full and final settlement and asking for bank details to send bacs payment to?

 

please help extremeley confused

How many accounts did/do you have with Welcome?

 

Can you give more details please?

 

You say you have received offers....before accepting I think you ought to make sure that they are at least close to the correct amount due. Have you done any calculations on your ppi claims yourself?

to be honest i have not a clue,we renewed loans with them and i found a total of 7 policies however some only had medicare 24 on ?on the compensation calculation they sent me there are 2 accounts which state closed,the total ppi on 1 is £2,435.05 and on the second £3,152.40 less rebate of £1.904.13 then on 2nd account £2.558.10 perhaps this was renewed?dont understand this , then interest added of £291.88 and £343.74 can upload document if needed the total offer including interest is just over £2000. is this offer inconjuction with the fso?

Hi there

 

Ok, you have two options.

 

1 Accept the offer they have made. This means you will be accepting an offer on which you are "In the dark" about.

 

2 Ignore what they have sent you. I wouldn't worry about their 10 day bit becasue if you are not in full possession of the facts you cannot make an educated decision. In this case I would be sending a Subject Access Request to get all information they hold on you. This will include copies of agreements and all of the transaction history. This information will let you calculate the correct amount due to you whch you can compare to the offer and make your decision based on that.

 

Now, if it was me I'd go for option 2. I would want to make sure I am not accepting an incorrect offer. In my opinion they cannot hold you to a 10 day deadline if you haven't got all the facts to enable you to make a decision.

i'd post all the agreements up

 

if you've had multiple loans, then i bet you rolled them and got no rebates either

 

so ppi on ppi with int recharged too

 

as for the other insurance, you can reclaim them all! even mideicare just the same under a diff name.

 

i would think you got stung with letter/phone fees too

 

all can be reclaimed

 

post em up

 

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

sorry dont have any of the agreements and sent the original insurances to the Fscs when they sent me the application form , i have found a statement on a secured loan to Ge money where we paid off our accounts to Welcome to the tune of £21,401.56 in October 2005!!!! and we are still paying deductions from wages yet all have different account number totally baffled!!!.Possible that should not be paying this !!!

Is this offer seperate to the claim we have commenced with the fscs?

as could really do with the money since getting involved with Welcome and GeMONEY help please

you took out a loan with ge to pay off welcome

 

blimey....

 

if all of this can be unravelled, i bet you are owed £1000's

 

so the fscs do have the agreements?

 

what does exist please.

 

i'm looking here at the figures you took at the time from welcome to get the loan from GE were WAY off the mark

 

thus the ge loan was too high and ofcourse had even more interest added to ppi on pii etc etc when/if you rolled the welcome loans

 

this will be an interesting case!
