Really struggling now - is it worth me contacting them to ask them to get an extension on the action........

 

haven't read all the thread. but.

if you want to try for an extension up to 28 days under civil procedure rule part 15.5 - give them a call (or write if time) and ask for an extension to ....(being a date up to 28 days from the defence deadline). ask them to confirm in writing by return the agreed specific extension date. if they kick up, mention that it would unreasonable for them not to agree. log the call. once letter received, write/fax to the court accordingly attaching a copy of their letter agreeing to the specific extension. if they don't agree to an extension, be minded to get a defence in in time.

if get the full extension, could still do a cpr 31.14 and/or 18 request in time for any relevant docs? could do them anyway?

also btw, any missold ppi and/or unreasonable charges could form part of a defence (if not already settled) as it would render the amount claimed inaccurate?

there may be other issues? see what they come up with re the defence extension?

Sorry - to keep asking questions but they have said this

"We write to confirm that we are willing to agree to an extension of time for filing your defence until 4pm on XXX"

 

So I have said this to the Court

"In respect to the above claim; please find attached copy letter from the Claimant’s solicitors confirming their willingness to agree to an extension of time to file my defence until 4pm on the"

do I need to say anything more ?

Got my letter agreeing to an extension - court says to fax - should I send Special Delivery to ensure receipt also !

If you fax it you could write on the header sheet (front page) to telephone you upon receipt and when they ring, ask for their name. However, if you feel more comfortable, then send by S/D.

Hello all - am looking to send a cpr 31.14 request to Morgan's as Ford suggested : I was thinking of asking (yet again) for signed copies of the agreements, Termination Notice, Default Notice,statements and a copy of the Notice of Assignment rather than just the photocopied thing they sent me . Is it also possible to ask them to expand upon their particulars of claim in order to defend myself more full ? basically to see what they have in their claim......sorry but this is worrying me silly - so scared of saying or doing the wrong thing; have spent the last week ploughing through the forum for any cabot / citi threads and am even more confused now than I was before.

Can anyone point me to a template for this ?

Thank you for your patience - I never thought I would be in this situation five years down the line after negotiating successfully with my other creditors.

You are going to get photo copies I'm afraid, as long as they are legible,

there is not much more you can ask.

I've had access problems on the site today, have got a copy of the POC you can post

up, sorry if you have but I can't get back to previous posts.

Sorry glitch again,

The best course in my opinion is to do a Subject Access Request under the Data Protection Act to give you all

the data held on the account.

The cost is £10.00 statutory fee and they have 40 days to respond, there is an excellent template in the CAG.

All your correspondence looks good to me,we have established that Morgans solicitors is named after the Commercial Director of Cabott Piers Morgan,

you are dealing with a paralegal when communicating with them have a Look at Lamb 99's thread on Cabott and Morgan,it will give you some idea what they are like.

Thanks very much for getting back to me - have just found a brilliant thread about 31.14 am busy going through it - when I have written the letter I will post it up for comments.

Have been following Lambs thread with much interest and sympathy (you were so supportive to him) and it has given me the courage to try and do something.
