      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello

 

Received two letters today one from the post office asking for full payment of my credit card and one from DLC.

All charges and interest has now been stopped.

 

I rung DLC spoke to a guy who said that the offer of £8.17 per month was not acceptable I owe under £2000 to this credit card.

I explained I couldn't pay any more and I had used the calculator letter used by the courts to calulate payment to each card.

 

DLC said that they would take legal proceedings and put a charge on my property if I didn't pay £32.66 per month.

Again I explained that I couldn't pay this and I thought it very unlikely that they could put a charge on my property.

 

DLC then suggested a payment of £16.33 which I agreed to.

I would not give them my bank details to set up a direct debit I told them I would set up a standing order.

DLC totally dismissed all the advice I had been given by CCCS and they said that the post office operate differently and the debt had to cleared within 5yrs.

 

What should I have done?

The debt will be reviewed in August 2011.

DLC said that my debt was still with the post office they were just dealing with it on behalf of the post office.

Hi Floridagirl.1st thing stop the phone calls,keep everything in writing please.

 

As DLC are only acting for the Post Office,ignore DLC deal direct with the Post Office state you have taken guidance from CCCS and you can afford to pay them £8.17 and start paying it by Standing Order.You only need pay what you can honestly afford.

 

Do not worry most credit card companies would like to have the debt cleared within 5 years,if this looks unlikely they will sell the debt on.

 

If you want to keep DLC quiet send them a CCA request along with the £1 PO and send recorded,and see what this turns up

Hi,

 

I have a card with post office too, i couldnt afford payments and sent a letter offering a payment of £40pm, i owe £1600 on it, a few days after sending my offer letter i got a letter telling me a default notice is going to be issued, i was issued the default notice and heard nothing for 2 wks, now i have received a letter from dlc and they are looking for the full balance, i spoke to them and they said that if i am making a repayment offer with post office i need to ask the post office to contact dlc to send the account back to them. I spoke to the post office who said my account was with the legal team, i spoke to a guy in the legal team who has agreed to my payment of £40pm even though i was told about 6 times that they wouldnt accept that payment, he has said that as long as i keep to my payment of £40pm he is happy to leave the account as it is. He was very helpful but did say that payplan advice doesnt work with them and that the post office has their own rules on how to deal with debt. Crazy huh!!

just wanted to let you know coz i know how it feels to be in this position.

Hi Floridagirl,How are you getting on with DLC? are you paying the PO the £8.17 direct ?

 

Regarding Barclaycard yes they are the most frustrating company to deal with,are you running this under a separate thread?

I have had a letter from DLS and I agreed the £16.33 a month, I realised after I had done this I should have stuck out but the damage was done.

Barclaycard have agreed to my offer and have put an arrangement in plcae but said that after a couple of months I will be referred to Mercers whom I know is their in house DCA. I was having harrassing phone calls at all hours and barclaycard have removed my tel and my mobile no from their records. We now have to sort out my other half's 2 barclaycard credit cards then they are all under an arrangement then. I guess credit card companies just keep coming back ever few months to scare monger, I will deal with each situation as it arises.

Hi it appears things are heading in the right direction.Are there any charges and or PPI to recover?

 

You are correct there is a distinct pattern with the OCs they usually pass the debt on to their in house DCA so no change there,then it gets farmed out to another 2/3 DCAs then gets sold to yet another DCA,your attitude of just deal with it as it happens is fine.However on the way see what can be claimed back to reduce the debt,
