I have issued on the halifax, for 1485 (guesstimate) of charges. They have relented and offered to refund me all my charges. However since this has happenned i have been slapped for more charges and each time i get one i ring them and tell them to readjust their offer. Which they do so i thought i d be cheeky and ask them to zero my overdraft and close the account (that s 1600 odd) and essentially write off the debt. They said they are not prepared to do that and they said if you go to court the judge will ask for evidence of the debt and if i cant provide it then the court will strike off the claim. So i said well we shall see in court if this is true. They now say they will be sending me a letter updating the claim and stating their position.

 

 

is this true about striking off claims if you dont have the evidence for all of it but say only some of it?
