      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello again,

I have read and also been informed that PPI reclaims have no time limit, so I thought back to a PL I took out with Natwest in 1998 for around £2k.

I remember very well the "sale" of the PPI though, no explanation of features or benefits, or discussion about if it was suitable, just was told "this is good to have"

Problem is I have no paperwork any more, and, only know that it was taken out sometime in 1998.

I was 18 at the time and also on a rolling short term contract at work at the time, if that makes any difference.

Will it be possible to request details about this PL and PPI from Natwest after 12 years?

And if so how do I go about it?

I am already in the process of reclaiming from Creation and have a thread about that here on CAG.

Any help or advice is greatly appreciated.

I have a feeling that somewhere there is still a record, after having a quick look round the forum it appears that banks do keep information for longer than 12 years, although it's a struggle to get it from them.

Exactly lhmcr,

 

Can be very tough to get the information from them.

 

Might be worth sending Natwest a full SAR anyway and see what they come back with.

 

Read the sticky on the PPI homepage entitled " full sar for ppi" for guidance on how to do the SAR.

Regarding the original post I am shorlty going to send an SAR request to Natwest.

I used to have a current account and savings with Natwest as well as the personal loan I am finding out about, I am also a Natwest credit cad holder.

Will all the statements from these accounts be sent along with the details of the personal loan?

I received the the SAR for the last six years credit cards only, even though I specifically asked for any personal loans and other account info.

I sent it to the Edinburgh South Gyle address and have just sent an email to customer relations asking where the rest of the info is.

I hope this can get sorted.

Just spoke to customer relations again, I now have to send a letter to a different address, stating where I opened the PL, for how much and when.

I said that if it cannot be found they must send me confirmation that it has been destroyed.

If it turns out it HAS been destroyed does that mean that's the end of my claim?

Unfortunately I have received confirmation from Natwest that the have destroyed (or can't be bothered digging out) the details of the personal loan I had.

But I do find it strange that the Halifax still have details of an obscure kids savings account that was closed over 20 years ago!!!

Oh well, never mind, just Creation then.

wouldn't payments for the loan coming from your current account be circumstantial 'proof'?

here's what i'm thinking. if you had a loan for £1,000 and you made 11 monthly payments

of £100 (the 11th month being interest on the loan). anything on top of this would be an additional

charge.

 

could this be PPI?

 

well, the bank would have to explain it.

I'm trying to reclaim myself. Natwest had a PPI on my account back before they introduced

the Advantage Gold account. I got an SAR for the account up until may 2000 but i know i use to

£6.00 for PPI prior to this. What i don't know is whether this was monthly or annually?

Can anyone tell me which?

Also can you tell me whether i can claim for it and ask the bank to produce the proof in court as

Natwest aren't keen on giving me the rest of my account details.

Well then,

News to open a old thread.

After getting tired of Natwest giving me details of accounts I already have info for, and made it clear in my correspondence that I provided those details for identification purposes, I just went straight to the top, and miraculously they have found the loan and PPI that went with it.

I will now wait and see what they say.

Again, it's amazing what a letter to the top does.

I will keep you all informed.

Lhmcr1, I'm having similar trouble with RBS/Natwest. I've had an ongoing issue where they won't give me what I'm looking for and consistently send me information that tells me very little.

 

Do you have details of who you contacted at the top - I'd like to do something similar. I've been asking for a specific loan agreement that I suspect I had PPI on, which they insist they can't find. Also despite having my account since 1998, they apparently only hold data on the last 6 years. Not sure why, as their current system goes from October 2002 to now, and the archive system (available from the RBS computer system) goes back to 1991/2.

 

I suspect they're either lazy or just too busy to fulfil the requests. However, I asked for all information and I expect all information. Hopefully I can put a rocket up them and put this sorry tale to rest.

The letter was sent to the CEO, saying how unprofessional I found RBS's dealings with my letters.

What will be interesting now will be if they offer any refund, how will they calculate it? As it is over 12 years since the loan was open.

Are there any spreadsheets? Can interest be claimed for the full 15 years since opening?

And whose jurisdiction will it come under as it goes back 13-15 years?

Interesting times ahead.
