I was fined £275 by hmcs for a ms90, I agreeed to pay £40 pcm, although not always on time, i still paid. I had a letter requesting to pay the outstanding balance of £55, i paid this (minus a penny) within two weeks of receiving the letter. A week on... today, i have received a cheque for £54.99 from hmcs and a letter saying its now in the hands of the bailiffs?? What should i do?

I would advise NOT to bank the cheque as you are not entitled to the money back. Likewise, they have no power to refund it. Why did you leave a penny outstanding though? This seems to be asking for trouble?

You say that you had a letter to request £55 and that you paid this sum (minus a penny). How long after receiving this letter did you make the payment?

 

You need to also ask the court to CONFIRM the date that they isued the Distress Warrant.
