Hi all, I was asked by a family member to have a look at a loan agreement they had with Welcome Finance which had PPI included. They were told the loan was basically dependant on taking PPI so agreed on taking it.

I have read a few threads regarding claiming so after reading the agreement I noticed there was a part saying "Amount required to clear existing loan balance" and this was some £800 plus but they didn't have that agreement so i sent a CCA request and now have the two agreements showing all figures.

I now need to know how to calculate what would be expected should their claim be successfull and to use in the letter I send to them. Are the calculations done using their APR charged on the amount as they were single premium policies or is there a calculator for this?

Thx ver much donbracho that has helped me understand how the calculations are done, have another 2 questions if anyone can help:

 

On both agreements they tell you what your monthly payments are but dont break it down so im unsure how much of that monthly payment actually goes to PPI. Would how much you pay towards the PPI per month be shown in a SAR or can it be worked out via the agreement?

 

The first loan stopped (1 year into a 2 year agreement, so 50% used) due to being consolidated into the 2nd loan, at this point they (WF) returned some of the PPI premium but only 20% and took that off the balance so basically lost around 30% of what they paid, I know you dont get a proportionate rebate based on whats used but have i read correctly that as the 2 loans were stopped and started on the same day then there was no need to cancel the existing PPI which caused a poor rebate that this could have been topped up instead of cancelled then renewed? Just means they have benefitted from cancelling the first PPI due to poor rebate.

Ok having done my calculations I reckon the sum due comes to just under 6k, this includes the following:

 

Total PPI paid for Policy 1 & 2

 

Interest paid on these during agreements

 

8% stat int on policy 1 & 2 totals

 

8% stat interest on interest paid during agreements for each month paid.

 

 

Hope thats correct, now need to put together the letter.

Welcome Finance are now basically rolling over and paying out. I just completed a claim for a friend.

 

8 weeks start to finish, I didnt even bother with the SAR. I just included the account numbers and they did the rest. They will send you a standard questionnaire. This is the EXACT same one on the FOS website. Word for word. To save some time just download and copy that one.

 

I included the PPI was not fit for purpose and was not explained properly and was mis-lead to believe the loan was subject of accepting PPI. Dont go into to much detail.

 

Not even a single call from Welcome. Rolled over and deposited directly to his account. Waited exactly 7 weeks and 4 days. 3 days short of the 8 week limit.

They are paying £290 pm and only have 9 payments left on a 48 month payment plan, more than double what they actually got due to this PPI and its interest, never missed a payment but im now wondering if they should put the account in dispute for now until they find out whats happening.

Hi Bigmac,

 

Are you filling out the questionaire they sent you or the one loaded off the FOS website? They are one and the same.

 

Just keep it very light and fluffy, no major details. Just include the account number if you have it. It should be included on the paperwork they have sent.

 

I used the reasons, not fit for purpose (if the loan is on a longer term than the insurance, 10yr loan - 5yr PPI)

Mis-leading information from the agent. Led to believe the PPI was needed to secure the loan.

Were not informed of your cancellation rights.

Did not receieve a copy of the demands and needs statement or the terms and conditions of the PPI component.

 

This should be more than enough.

 

I got my mine back and did this one for a friend. Keep it simple and Welcome will pay back everything including the 8% interest.

 

You will get a letter with a breakdown of the refund, sign it and send it back registered (the acceptance)

You will get more paperwork a few days later with the new totals as if PPI was never added (they call this a re-book). You have to send this back before they will refund via Bacs into your chosen account.

 

Make sure everything is registered and signed for. Welcome have this strange habbit of Loosing paperwork.

Thx chiswicklass i have sent it back, i said the person had previous medical condition and that if a claim was made which related to that illness it would fail, also he now has cancer, been off work for quite some time but does get full pay, therefore showing there was never a need for the ppi, that and he was told the loan came with ppi and had already been approved. he did tell them he got full pay and that PPI wasnt needed but was told it was part of the loan. FINGERS CROSSED

Hi Kenny, long time no hear m8 had a crap year and be glad to see the back of it hope urs has been better lol.

 

Just to update this the family member involved has been offered a full refund and returned the document to them. Said would be paid within 30 days mind you, 34 and counting so far.

Still no payment despite sending them a reminder to sett le, when you calll them your told by a lovely automated service you are on hold for anything between 40 and 75 minutes, i done this once then got cut off after half an hour, grrrrrrrrr.
