If this is a defence, I think all you need to do is refer to the statutes etc.. you dont actually need to quote great swathes from them. that will be for your witness statement when you will need to attach and refer to documents that you will be relying on.

 

Hmmm so is this a Witness statement or amended defence because you now have further information ? I dont want to advise you take out information if it should be kept in.

Not my thing these statements but guessing that as you're still Billy No Mates I had a quick scan through...

 

7. The claimant states at paragraph 1 of both the interim and final part 18 response that their claim relates to a written agreement. The claimant has refused to attach[PROVIDE] a copy of this agreement as required by Practice Direction 16.7.3

Didn't Waksman say that the original had to be produced in court?

 

Most of the rest looks OK [confused the hell out of me in a quick read-LOL] but aren't the late charges etc generally accepted as penalty charges and are repaid more or less without a fight by the cc comanies when reclaimed albeit as a 'goodwill gesture' rather than an admittance?

 

As a whole it'll give the Judge something to think on hopefully.

What's happened here?

 

I am searching for Aplins threads and came across this one but it seems to have come to an abrupt halt!

The claim is stayed as DLC never contacted the court after I submitted a defence.

 

I've left it at that as there doesn't seem to be much that I can do. I have another case which is just about to be stayed automatically, so I would be grateful if anybody has any advice on how to proceed in these circumstances.

I have TWO claims that were both stayed within a month of each other in late 2010:

 

1. Hillisden (former MBNA)

2. Arrow Global (former Barclaycard)

 

Its only the Arrow Global claim that has been discontinued. I never started a dedicated thread for this.

 

Is it possible to de-merge the threads and change the titles of the one called 'Claims Stayed since..." to '"Arrow Global vs Littlebert ****Claim Discontinued****"
